Claim B: Compensation for Extraordinary Losses. Settlement Class Members will be eligible for compensation for extraordinary losses, including proven actual monetary losses, upon submission of a valid Claim Form and supporting documentation, provided that: (i) the loss is an actual, documented, and unreimbursed monetary loss; (ii) the loss was more likely than not caused by the Data Incident; (iii) the loss occurred between January 8, 2021 and the Claims Deadline; (iv) the loss is not already covered by one or more of the normal reimbursement categories (including Section 3.1(a) above); (v) the claimant made reasonable efforts to avoid the loss or seek reimbursement for the loss, including, but not limited to, exhaustion of all available credit monitoring insurance and identity theft insurance. The maximum amount any one claimant may recover under Claim B is $3,500.00.
Claim B: Compensation for Extraordinary Losses. Settlement Class Members will be eligible for compensation for extraordinary losses, including losses associated with identity theft, medical fraud, tax fraud, other forms of fraud, and other actual misuse of personal information, provided that (i) the loss is an actual documented and unreimbursed monetary loss; (ii) the loss was more likely than not caused by the Laptop Incident; (iii) the loss is not already covered by one or more of the ordinary loss compensation categories under Claim A; (iv) the claimant made reasonable efforts to avoid the loss or seek reimbursement for the loss; and (v) the loss occurred between the date of the Laptop Incident and the Claims Deadline. The maximum amount any one claimant may recover under Claim B is $2,500.00. Additionally, if the claimant previously signed up for and obtained credit monitoring from Xxxxxx due to the Laptop Incident, then such claimant may request that the monitoring be renewed or extended for an additional year, such request to be granted by Xxxxxx at Xxxxxx’x expense.
Claim B: Compensation for Extraordinary Losses. Settlement Class Members will be eligible for compensation for extraordinary losses, including losses associated with identity theft, medical fraud, tax fraud, other forms of fraud, and other actual misuse of personal information, provided that (i) the loss is an actual documented and unreimbursed monetary loss; (ii) the loss was more likely than not caused by the Data Incident; (iii) the loss is not already covered by one or more of the normal reimbursement categories under Claim A; (iv) the Settlement Class Member made reasonable efforts to avoid the loss or seek reimbursement for the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance, including from Experian’s IdentityWork’s identity theft protection services offered by Clearway to the extent such Settlement Class Member enrolled in such services; and (v) the loss occurred during a specified time period. Claimants who submit qualifying claims under this category may also seek reimbursement for up to 5 hours of additional lost time at the rate of $20 per hour for time spent dealing with issues relating to the identity theft, fraud, or other misuse, if at least one full hour was spent dealing with the Data Incident, provided that the claimant provides documentation or a narrative explanation plausibly establishing that the time was spent dealing with issues relating to the Data Incident. The maximum amount any one claimant can recover under Claim B is $2,500.
Claim B: Compensation for Extraordinary Losses. Settlement Class Members will be eligible for compensation for extraordinary losses, including proven monetary losses, upon submission of a Valid Claim Forms provided that (i) the loss is an actual documented and unreimbursed monetary loss; (ii) the loss was more likely than not caused by the Data Incident; (iii) the loss is not already covered by one or more of the ordinary loss compensation categories under Claim A; (iv) the claimant made reasonable efforts to avoid the loss or seek reimbursement for the loss including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance; and
Claim B: Compensation for Extraordinary Losses. Settlement Class Members will be eligible for compensation for extraordinary losses, including proven actual monetary losses, upon submission of a valid Claim Form provided that: (i) the loss is an actual, documented, and unreimbursed monetary loss arising from identity theft, fraud or similar misuse; (ii) the loss from identity theft, fraud, or misuse was more likely than not caused by the Data Security Incident; (iii) the actual identity theft, misuse, or fraud loss is not already covered by one or more of the ordinary loss compensation categories under Claim A; (iv) the claimant made reasonable efforts to avoid the loss or seek reimbursement for the loss, including, but not limited to, exhaustion of all available credit monitoring insurance and identity theft insurance; and (v) the actual misuse or fraud loss occurred between the date of the Data Security Incident (February 21, 2022) and the Claims Deadline. The maximum amount any one claimant may recover under Claim B is $4,000.00.
