Common use of Birth or Adoption Clause in Contracts

Birth or Adoption. Such leave is intended to cover the required attendance of the employee for birth or adoption proceedings where the children involved are or may be dependents of the employee. Where proceedings can be scheduled to accommodate the employee’s schedule such should be done, but very often court proceedings, or the actual adoption arrangements may have to fit the schedule of the agency or court involved. Similarly, attendance just prior to, during, and following birth, can rarely be predicted with much accuracy. Generally it might be reasonable to grant some time under this provision where a father has been up most of the night (at birth) and needs half a day or so to recover. It is a section of the guidelines which requires an understanding application.
