Accounting of PHI Disclosures. Business Associate agrees to document disclosures of PHI and information related to such disclosures as would be required for Covered Entity to respond to a request by an individual for an accounting of disclosures of PHI in accordance with 45 CFR § 164.528. Within five (5) days of receipt of a request by Covered Entity, Business Associate shall make available to Covered Entity the information required to provide an accounting of such disclosures. Any accounting information shall include the information described in 45 CFR § 164.528(b), including, without limitation: (i) the date of disclosure of PHI; (ii) the name of the entity or person who received PHI and, if known, the address of the entity or person; (iii) a brief description of PHI disclosed; and

Accounting of PHI Disclosures. Covered Entity will include in individual accountings requested under the Privacy Laws, including without limitation, 45 C.F.R. § 164.528, any disclosures by Business Associate.

HMS will include in individual accountings requested under the HIPAA Rules, including without limitation, 45 C.F.R. § 164.528, any disclosures by DHCRC to HMS, and by DHCRC to the User, to the extent such disclosures are applicable. The User will provide, upon written request from DHCRC, information regarding all such disclosures by the User in order to allow HMS to comply with this subsection and 45 C.F.R. § 164.528.
Accounting of PHI Disclosures. SART agrees to document disclosures of PHI and information related to such disclosures as would be required for ART Clinic to respond to a request by an individual for an accounting of disclosures in accordance with HIPAA.

At the request of Covered Entity, Business Associate will document and report to Covered Entity all disclosures of PHI that are required for Covered Entity to provide an accounting under 45 C.F.R. § 164.528 and/or the Privacy Laws. If an individual contacts Business Associate directly for such an accounting, Business Associate will direct the individual to contact Covered Entity.
