Document Disclosures. Business Associate agrees to maintain sufficient documentation of such disclosures of Protected Health Information by Business Associate as would be required for Covered Entity, or Business Associate on its behalf, to respond to a request by an Individual for an accounting of disclosures of Protected Health Information in accordance with 45 C.F.R. §164.528.

Document Disclosures. Document such disclosures of PHI and information related to such disclosures as would be required for Covered Entity to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 CFR §164.528. Within ten (10) business days of a written request by Covered Entity, the Company agrees to provide to Covered Entity information collected in accordance with this Section in order for Covered Entity to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 CFR §164.528. If the Company receives a request from an individual or an individual’s designee for PHI, the Company shall forward any such request to Covered Entity within ten (10) business days and will coordinate any responsive communication to the request as directed by Covered Entity.
Document Disclosures. Pursuant to a schedule to be established by the Arbitrator, the parties shall exchange those documents upon which the producing party may rely in support of any claim or defense. The parties may further exchange documents in response to written requests for disclosure of non-privileged documents directly relevant to the determination of the issues presented for determination by the Arbitrator. Any Dispute regarding such requests for disclosure or the adequacy of any party’s disclosures shall be determined by the Arbitrator consistent with the expedited nature of arbitration. The Arbitrator shall take into account applicable principles of legal privilege and related protections, such as those involving the confidentiality of communications between a lawyer and a client and the work product of a lawyer, and no party or witness may be required to waive any privilege recognized at law. The Arbitrator shall issue orders as reasonably necessary to protect the confidentiality of proprietary information, trade secrets, and other sensitive information disclosed.
Document Disclosures. Business Associate agrees to document such disclosures of Protected Health Information and information related to such disclosures as would be required for CHP or Business Associate to respond to a request by an Individual for an accounting of disclosures of Protected Health Information in accordance with Section 13405 of the HITCECH Act and 45 CFR §164.528. To that end, unless otherwise protected or prohibited from discovery or disclosure by law, Business Associate agrees to provide to CHP or directly to an Individual, as directed by CHP pursuant to Section 13405(c)(3) of the HITECH Act, upon reasonable notice, information thus collected, to respond, or to permit CHP to respond, to a request by an Individual for an accounting of disclosures of Protected Health Information in accordance with Section 13405 of the HITCECH Act and 45 CFR §164.528. If Business Associate receives any request for access, amendment, accounting of disclosure, or other similar request directly from an Individual, Business Associate will promptly notify CHP of such request.
