Xxxxxxx Personal Data means Personal Data of the Xxxxxxx Group that is used in or by, or otherwise related to, any Xxxxxxx Retained Business.

Xxxxxxx Personal Data means i) any Personal Data that is collected by or on behalf of, identifies, relates to, describes, is capable of being associated with or identifying, or could reasonably be linked (directly or indirectly) with Xxxxxxx, including without limitation, any Personal Data that relates to or could be associated with Xxxxxxx’x employees, customers, and/or prospects, and/or other end-users of Xxxxxxx’x products, services, websites, advertisements, or content; and ii) any Personal Data acquired by or obtained by or on behalf of Xxxxxxx, or Processed by or on behalf of Xxxxxxx, or made available to Service Provider or any third party on behalf of Xxxxxxx in connection with, or in relation to, the Agreement, this Exhibit B, and/or the provision of any products or services to, or on behalf of, Xxxxxxx. Xxxxxxx Personal Data includes any aggregated, deidentified or other derivative of other Xxxxxxx Personal Data. As between Service Provider and Xxxxxxx, all Xxxxxxx Personal Data is and will be deemed to be and will remain the exclusive property of Xxxxxxx.

  • In the event of any conflict or inconsistency between this Agreement and the DBS Xxxxxxx Personal Data Protection Policy, the former shall prevail.

  • Service Provider warrants that if there has been a Data Incident, all responsive steps will be documented and a post-incident review will be made of both the events and also actions taken, if any, to change business practices relating to Personal Data and Xxxxxxx Personal Data.

  • Xxxxxxx reserves the right to conduct (by itself or through a designated, reputable third party) ongoing manual and/or automated reviews, scans, audits, and assessments, including, without limitation, on-site audits and testing of any locations where Xxxxxxx Personal Data is stored or otherwise Processed, to monitor, assess, and ensure Service Provider’s compliance with its obligations under Applicable Law and this Exhibit B.

  • Upon Xxxxxxx'x written request, or alternatively via running list on a shared document, Service Provider will promptly identify in writing all individuals who have been granted access to the Xxxxxxx Personal Data as of the date of the request and Service Provider will provide Xxxxxxx with copies of agreements (redacted to exclude commercial terms) executed by all third parties with access to Xxxxxxx Personal Data, for Xxxxxxx’x inspection.

  • Service Provider shall reimburse Xxxxxxx for all costs incurred in responding to and/or mitigating damages caused by a Data Incident involving Xxxxxxx Personal Data, including, without limitation, costs of forensic investigation, regulatory fines, notification costs, credit monitoring, and/or reasonable attorneys’ fees.

  • In the absence of such a written request, the Xxxx.xxx Personal Data Retention and Deletion Policy provides for automatic deletion or de-identification of Xxxx.xxx student accounts after five (5) years of inactivity.

Related to Xxxxxxx Personal Data

  • Personal Data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

  • Customer Personal Data means the personal data contained within the Customer Data.

  • Client Personal Data means any personal data provided to us by you, or on your behalf, for the purpose of providing our services to you, pursuant to our engagement letter with you;

  • Company Personal Data means any Personal Data Processed by a Contracted Processor on behalf of Company pursuant to or in connection with the Principal Agreement;

  • non-personal data means data other than personal data as defined in point (1) of Article 4 of Regulation (EU) 2016/679;

  • Relevant Personal Data means Personal Data in respect of which we are the Controller.

  • Shared Personal Data means the personal data to be shared between the parties under clause 1.2 of this agreement to enable the parties to fulfil their obligations under the terms of this Agreement.

  • Personal Information Breach means an instance where an unauthorized person or entity accesses Personal Information in any manner, including but not limited to the following occurrences: (1) any Personal Information that is not encrypted or protected is misplaced, lost, stolen or in any way compromised; (2) one or more third parties have had access to or taken control or possession of any Personal Information that is not encrypted or protected without prior written authorization from the State; (3) the unauthorized acquisition of encrypted or protected Personal Information together with the confidential process or key that is capable of compromising the integrity of the Personal Information; or (4) if there is a substantial risk of identity theft or fraud to the client, the Contractor, the Department or State.

  • Cardholder Data has the meaning defined by the PCI Security Standards Council, Payment Card Industry (PCI) Data Security Standard (DSS) and Payment Application Data Security Standard (PA-DSS), Glossary of Terms, Abbreviations, and Acronyms, Version 3.0, January 2014, currently available online at: xxxxx://xxx.xxxxxxxxxxxxxxxxxxxx.xxx/documents/PCI_DSS_Glossary_v3.pdf. For the term of this Contract, Contractor will maintain a provisional Authority to Operate (ATO) at the Moderate Level from the Federal Risk and Authorization Management Program (FedRAMP) Joint Authorization Board (JAB) or Federal Agency for any and all Cloud Services provided under this Contract. For the term of this Contract, Contractor will maintain an ISO 27001 Certification for any and all Cloud Services provided under this Contract.

  • Customer Proprietary Network Information (“CPNI”) is as defined in the Act.
