Unexcused definition

Unexcused shall be defined as those shifts when an employee does not provide a voluntary certificate of illness/injury. If an employee is unable to provide a valid certificate of illness/injury when required, the missed shift shall be considered an unexcused absence. If an employee has more than five (5) unexcused absences in a calendar year the employee shall be subject to the procedure described in Article 16 Section 5(b) and subject to the procedure described in Rule and Regulation 2.4 (Absence from Duty Without Proper Authorization). Authorized leave used in accordance with Article 38 Miscellaneous Leaves, Article 21 Service Connected Disability and Rule and Regulation 2.21 (FMLA) shall not be subject to this provision. The certificate of illness/injury shall be submitted to the Fire Chief or his/her designee, in accordance with the Certificate of Illness/Injury (COI) Rule and Regulation.

Examples of Unexcused in a sentence

  • Unexcused nonperformance by Con Edison shall, however, relieve Contractor of its obligation to perform hereunder to the extent that it prevents Contractor from performing.

  • An Unexcused Delay shall not entitle Contractor to either an extension of the Contract Time or an adjustment of the Contract Sum.

  • To the extent an Unexcused Delay is concurrent with an Excused Delay, the Excusable Delay shall be conclusively deemed an Unexcused Delay.

  • If the delay is an Unexcused Delay, the Design/Builder shall prepare a recovery schedule for the Owner's review and approval, showing how the Design/Builder will compensate for the delays and achieve Substantial Completion by the date shown on the Schedule.

  • If the Design/Builder is unable to demonstrate how it will overcome Unexcused Delays, the Owner may order the Design/Builder to employ such extraordinary measures as are necessary to bring the Work into conformity with the Substantial Completion Date set forth therein, the costs of which shall be paid as Cost of the Work.

  • Unexcused tardiness or absence of any duration shall be charged as absence without leave (AWOL).

  • Unexcused absences before or after a holiday shall cause a forfeiture of pay for both the day of the unexcused absence and the holiday.
