TOPrS Trustee definition

TOPrS Trustee means the indenture trustee under the TOPrS Indenture and the TOPrS Supplemental Indenture, currently Wells Fargo Bank Minnesota, N.A., as successor Indenture Trustee and as successor Property Trustee.
TOPrS Trustee means, collectively, the trustee with respect to the TOPrS Trust and the indenture trustee under the Convertible Debenture Indenture.
TOPrS Trustee means, collectively, (i) the Indenture Trustee under the TOPrS Indenture and the TOPrS Supplemental Indenture, (ii) the Property Trustee for the holders of the TOPrS, (iii) the Guarantee Trustee with respect to the TOPrS Guarantees, and (iv) the Property Trustee, as the sole holder of the 6% Convertible Subordinated Debentures due 2016, currently Wells Fargo Bank Minnesota, N.A.

  • Nothing contained in this Plan shall constitute a waiver or release by the Debtors of any rights of setoff the Debtors may have against any Person other than holders of Old Senior Notes, TOPrS Certificates, the GPH Note, the Old Senior Note Trustee and the TOPrS Trustee.
