Tier 3 Data definition

Tier 3 Data means sensitive or proprietary information and data elements with a statutory requirement under Data Trust Member's relevant state and federal laws for notification to affected parties in case of a confidentiality breach (e.g. Social Security Number, driver's license number, financial account numbers, personal medical information, etc.) provided on an ongoing basis or as a one-time transfer to Trustee by Data Trust Member for use by Data Trust under this Agreement as detailed in Exhibit B attached hereto or subsequently contributed by Data Trust Member and detailed in the Data Trust electronic metadata registry. Examples of Tier 3 Data may include, but not limited to: Attorney-Client Privileged; Criminal Justice Information; Critical Infrastructure Information; Family Educational Rights and Privacy Act (FERPA); Federal or State Tax Information; or Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA).

Examples of Tier 3 Data in a sentence

  • Upon termination Data Trust Member may elect to have the Trustee destroy their Tier 0, Tier 1, Tier 2, and Tier 3 Data.

  • For the avoidance of doubt, Data Trust Member shall be solely responsible for obtaining all necessary consents and otherwise complying with applicable law in transmitting Tier 0, Tier 1, Tier 2 and Tier 3 Data to the Trustee and to permit the Trustee to perform its obligations pursuant to this Agreement.

  • Trustee agrees to keep all Tier 1, Tier 2 and Tier 3 Data Trust Member-Contributed Data Resources confidential and only disclose them to employees, affiliates, contractors or agents who need access in order to meet Trustee’s obligations and requirements for Data Trust Members and the Data Trust for the purposes contemplated by this Agreement and the attached Exhibits.

  • The Rack Space is provisioned within BT dedicated suite space at the Site which is Tier 3 Data Centre facility with completed Threats, Vulnerabilities and Risks Assessment status (TVRA).

  • Tier 3 Data is considered confidential information of CampfireSocial and may not be shared with any third-party or other organization and may only be used in accordance with these Vendor Terms.

  • The hosting environment achieves the highest standards and capability of a high-grade Tier 3 Data Centre.

  • Salesforce uses Tier 3 Data Centres across the world, which provide 99.95% availability.

  • They are a standardized set of unified communications subscriptions bundles based on either an Avaya Aura or Mitel MiCD platform which are hosted in Windstream Hosted Solutions Tier 3 Data Centers and delivered through a private cloud environment.

  • Proposed Data Centre Facilities must: be located in New South Wales (NSW) or Australian Capital Territory (ACT); have a PUE 1.6 or less; have a minimum site designed capacity of at least 1 million Voltage Amps (MVA); meet or exceed the Uptime Institutes standard for a Tier 3 Data Centre; and be certified to PSPF Zone 3 or above, or be able to demonstrate that areas within the Proposed Data Centre Facility can be uplifted to be certified to PSPF Zone 3 of that area.

  • Proposed Data Centre Facilities must: be located in New South Wales (NSW) or Australian Capital Territory (ACT); have an average PUE 1.6 or less; have a minimum site designed capacity of at least 1 million Voltage Amps (MVA); meet or exceed the Uptime Institutes standard for a Tier 3 Data Centre; and be certified to PSPF Zone 3 or above, or be able to demonstrate that areas within the Data Centre Facility can be uplifted to be certified to PSPF Zone 3 of that area.
