During the Partial Rent Abatement Period, the rent abatement set forth above is for Base Rent only and Tenant shall pay all Additional Rent, including but not limited to Additional Rent for Taxes and/or Operating Costs, and for the cost of utilities supplied to the Premises during the Partial Rent Abatement Period and for any services directly contracted for by the Tenant.
In addition, so long as Tenant is not in default under the Lease, as amended hereby, Tenant shall be entitled to an abatement of Tenant’s Pro Rata Share of Operating Expenses during the Rent Abatement Period (collectively with the Abated Base Rent, the “Abated Rent”).
In the event Owner terminates this Agreement during the Rent Abatement Period, then Owner acknowledges and agrees that a reasonable and liquidated cost to be reimbursed to Tenant as a result of such termination is the value of the total rent abatement that would have been provided during the remaining Rent Abatement Period.
Provided that Tenant is not then in monetary or material non-monetary default under the Lease, as hereby amended, beyond any applicable notice and cure period, Tenant shall not be required to pay any Base Rent attributable to the Premises (the "Base Rent Abatement") during the two (2) month period commencing on February 1, 2015 and ending on March 31, 2015 (the "Base Rent Abatement Period").
Notwithstanding the terms of Section 4 above, Tenant’s obligation to pay Minimum Rent shall be waived for three (3) months commencing on the first day of the first full month after Tenant has commenced operating in the Expansion Space (the “Rent Abatement Period”); provided, however, that Tenant shall be responsible for the payment of Additional Rent during such Rent Abatement Period.
During the Rent Abatement Period, only Rent shall be abated, and all other costs and charges specified in this Sublease shall remain as due and payable pursuant to the provisions of this Sublease.
As long as the County is not in default of its obligations beyond any applicable cure period under this Lease, Landlord shall xxxxx one hundred percent (100%) of the Base Monthly Rent for the Base Monthly Rent Abatement Period.
During the Base Rent Abatement Period, only Base Rent shall be abated, and all Additional Rent and other costs and charges specified in this Amendment and the Lease shall remain as due and payable pursuant to the provisions of the Lease and this Amendment.
Provided that Tenant is not then in default of the Lease, as amended, then during the months of July and August for calendar years 2013, 2014, 2015, 2016, 2017, 2018, and 2019 (the foregoing 14 months to be known collectively as the “Rent Abatement Period”), Tenant shall not be obligated to pay any Base Rent otherwise attributable to the Premises during such Rent Abatement Period (the “Rent Abatement”).
If an Event of Default shall occur during such New Rent Abatement Period, Tenant shall not be entitled to any abatement of Base Rent in connection with the Premises during any part of the New Rent Abatement Period occurring after such Event of Default occurs.
