Payments on account. If you request, we will, subject to our prior consent which consent will not be unreasonably withheld, make payments to you monthly on account in respect of the cover under this section, provided always that:
Payments on account. We may require payment or part payment of our charges and disbursements in advance.
Payments on account. In respect of any section where amounts recoverable from the company are delayed pending finalisation of any claim, payments on account may be made to the participant, if required, at the discretion of the company.

Payments on account. (a) BofI shall establish a segregated deposit account in the name of “Emerald Financial Services, LLC, as Servicer” (the “Distributions Account”) into which it will credit, on a daily basis, all funds received on the Accounts, including all Loan Participation Cash Flows. Servicer shall have the right to make deposits to and withdrawals from the Distribution Account, for the benefit of BofI and Participant, and manage all Advances and Distributions consistent with the terms of this Agreement. BofI shall charge no fees on the Distributions Account. BofI hereby waives all set off rights with respect to the Distributions Account. Servicer, on behalf of the BofI, shall account for and distribute all Distributions on each Business Day during the Promotional Period, and on a monthly basis during any month that is not during the Promotional Period, as follows:

Tenant shall, when requested by Landlord and with each Monthly Payment, make such payments in advance as Landlord shall reasonably determine to be sufficient to provide in the aggregate a fund adequate to pay, when due, all additional rent required pursuant to Sections 3.03 and 3.04. Any deficiency shall be payable within the time set forth in said Sections, and any surplus shall be credited against outstanding rent or other charges due from Tenant, if any, and any balance shall be refunded to Tenant.
