Prime residential contractor means: (a) A prime contractor that is engaged in the business of making improvements to a single-family residence of a residential homeowner; and (b) the prime contractor's principals, partners, officers, directors, members, vice principals, and agents with executive, managerial, supervisory, physical, or actual control over the accounting or disbursement of amounts received by the prime residential contractor from or on behalf of residential homeowners.
