Post Employee definition

Post Employee means any individual who immediately following the Distribution Date is employed by Post or any member of the Post Group as a common law employee, including active employees and employees on vacation or an approved leave of absence. An individual who was employed by Post Foods LLC or Post Holdings, Inc. or its subsidiaries prior to the Distribution Date and whose name is listed on Schedule 1.01B hereto shall be referred to herein as a former Post Employee.

  • All workers’ compensation Liabilities relating to, arising out of, or resulting from any claim by a Post Employee or former Post Employee who is not a Ralcorp Employee that results from an accident, incident or event occurring, or from an occupational disease which becomes manifest, on or after the Distribution Date shall be the responsibility of Post or a member of the Post Group.
