Current Employee definition
Current Employee has the meaning set forth in Section 7.8(a).

Nothing in this Agreement is intended to confer upon any Current Employee or former employee or service provider of SpinCo, the Company or either of their respective Subsidiaries or Affiliates (or an EOR) any right to continued employment or service, or any recall or similar rights to an individual on layoff or any type of approved leave.
No provision of this Agreement shall be construed to create any third-party right to any Person, including compensation or benefits on the part of any Current Employee or other future, present, or former employee of any member of the SpinCo Group or RemainCo Group under any Company Employee Benefit Plan, Transferred Plan or otherwise.

Current Employee means an employee of the Company.
Current Employee means, with respect to a Person, any individual who is actively employed by such Person or on a short-term leave of absence (including maternity, paternity, family, sick or short-term disability leave, qualified military service under the Uniformed Services Employment and Reemployment Rights Act of 1994, and leave under the Family Medical Leave Act and other approved leave but excluding, for the avoidance of doubt, any individual who is on long-term disability).

Current Employee means an individual who is a current employee (including an executive director) of the Company or any Subsidiary on the Award Date;
Current Employee means any officer or other employee of any Seller, in either case who as of the Closing Date is employed by one of the Sellers, including any such employee who is on (i) temporary leave for purposes of jury or military duty, (ii) vacation or (iii) maternity or paternity leave, leave under the Family Medical Leave Act of 1993, short term-disability or medical or sick leave or other approved leave (any Current Employee described in clauses (i) through (iii), a “Leave Employee”).

Current Employee means any individual who is employed by any Seller or any Affiliate of any Seller immediately prior to the Closing Date primarily in connection with the Business, including any such individual on leave of absence, maternity or paternity leave, vacation, sick leave, short term or long term disability, military leave, jury duty or bereavement leave. All individuals employed by Marconi Canada shall be deemed employed primarily in connection with the Business. Except for the individuals set forth on Schedule 1.1A, all individuals employed by Marconi Mexico, Marconi Exportel and Marconi Administrativa shall be deemed employed primarily in connection with the Business.
