Phone Orders definition

Phone Orders means an Order for Services placed by Customer via telephone and accepted by CDGI pursuant to CDGI’s then current ordering procedures (as well as any amendment to such Order reflected in a change order agreed to by the Parties in accordance with the terms of the applicable change order, the Order and this Agreement).

Examples of Phone Orders in a sentence

  • Orders are not valid until signed by both Parties, except for Online and Phone Orders.

  • Buyer agrees to give prompt notice to Seller of any Loss or the assertion of any claim, or the commencement of any suit, action or proceeding in respect of which indemnity may be sought hereunder which Buyer deems to be within the ambit of this Section 8.06 (specifying with reasonable particularity the basis therefor) and will give Seller such information with respect thereto as Seller may reasonably request.

  • Online Orders and Phone Orders do not need to be signed by both Parties to be effective, but they will only be effective if Equinix accepts the Online Order or Phone Order in accordance with Equinix’s then-current ordering procedures or Equinix begins providing the Service ordered in the Online Order or Phone Order.

  • Equinix is under no obligation to accept an Order unless otherwise specified, reference to Order(s) shall also include Online Orders and/or Phone Orders.

  • SOWs, Online Orders and Phone Orders may also be collectively referred to as “Orders”.

  • For purposes of clarification, the prior sentence is not intended to modify or limit Equinix’s and Customer’s rights to (i) agree to Online Orders or Phone Orders pursuant to the terms of Section 9(f) below, (ii) amend Orders in accordance with the terms of a change order prepared by Equinix even where such change order does not require a writing executed by both parties to effect an amendment of such Orders, or (iii) enter into a Sales Order executed only by Customer and Equinix.

  • Unless otherwise mutually agreed, Equinix will Invoice monthly in [**] for all recurring Service Fees and in [**] for usage-based or non-recurring Service Fees, Service Fees will be listed on Orders, except for Online Orders and Phone Orders which win be subject to Equinix’s [**] price unless otherwise mutually agreed.
