When Provider assumes responsibility for serving a Covered Person from outside their CMHSP’s service area through a contractual agreement with another CMHSP (County of Financial Responsibility “COFR”) Provider retains responsibility for meeting the service needs of that Covered Person until (1) the responsibility is expressly and knowingly assumed by CMHSP, or (2) the Covered Person served relocates to another state or service area by choice.
The indemnification provided by this Section 9.3 shall continue as to a Person who has ceased to serve in the capacity by reason of which the Person was indemnified under this Section with respect to matters arising during the period the Person served in such capacity, and shall inure to the benefit of the heirs, executors, and administrators of such a Person.
