  • Where only a portion of the Generating Facility fails to achieve Commercial Operation by the Commercial Operation Date established in accordance with Section 4.4.4 of Attachment X, including any extension provided thereunder, Transmission Provider shall only terminate that portion of the GIA.

Operation Date means the date as of which a solar electric system or paired solar and storage system: has received its final inspection by the authority having jurisdiction; has received its final permit; is interconnected with the local utility distribution system if applicable; and is capable of generating and storing energy.¶
