Notice of Insufficiency definition

Notice of Insufficiency means the report described in Health and Safety Code Section 34183(b) of the Dissolution Act.
Notice of Insufficiency means a written communication from Honda to a Settlement 16 Class Member notifying the Settlement Class Member: (1) of Honda’s determination that the Claim 17 for Reimbursement or Proof of Replacement submitted by the Settlement Class Member lacks 18 sufficient information and requires further information or corroboration; (2) of the specific 19 deficiencies and explanation(s) therefor of the Claim for Reimbursement or Proof of Replacement; 20 (3) of any additional information or documentation required by Honda; (4) that the Settlement Class 21 Member has twenty (20) days from the date of the Notice of Insufficiency to either (a) submit the 22 additional information or documentation requested by Honda or (b) notify Honda and Class Counsel 23 in writing of the reason(s) why the information and documentation originally submitted with the 24 Claim for Reimbursement and Proof of Replacement is sufficient; and (5) that the Settlement Class 25 Member’s failure to perform either (4)(a) or (4)(b) shall constitute a waiver of the right to challenge 26 Honda’s determination and will result in the Settlement Class Member either receiving 27 Reimbursement in an amount less than that requested by the Settlement Class Member or a Credit.
Notice of Insufficiency shall have the meaning set forth in ‎Section 5.4(a)(i)(2).

Examples of Notice of Insufficiency in a sentence

  • Within forty- 11 five (45) days following the submission of a Claim for Reimbursement 12 or Proof of Replacement that Honda reasonably believes to be 13 insufficiently corroborated, invalid, illegitimate, and/or fraudulent in 14 terms of the right to receive Reimbursement or the amount of 15 Reimbursement requested, Honda shall send the Settlement Class 16 Member a Notice of Insufficiency.
