Literary Material definition

Literary Material means written matter, whether published or unpublished, in any form, including a novel, book, article, treatment, outline, poem, screenplay, teleplay, story, manuscript, letter, play or otherwise, which may be included in or upon which a Motion Picture may be based.
Literary Material. Written matter, whether published or unpublished ------------------- in any form, including a novel, treatment, outline, screenplay, teleplay, story, manuscript, play or otherwise, which may be included in a "Program" (as defined in Paragraph 2. below) or upon which a Program may be based.
Literary Material shall have the meaning set forth in the Master Agreement, except that for the purposes of this Agreement, Literary Material shall only pertain to the Main Characters or Subsidiary Characters as defined herein.

Examples of Literary Material in a sentence

Company agrees that all writing credits for programs written pursuant to the Sideletter on Literary Material Written for New Media shall be subject to the television credits schedule applicable to the program type.

MVL shall file a short form copyright license with respect to all copyrights licensed or assigned to MVL with respect to Literary Material evidencing its acquisition of the rights in and to the Literary Material.

I have retained at least one copy of the Literary Material and I understand that the Literary Material will not be returned to me for any reason.

Any and all agreements, assignments, instruments and other documents heretofore made pursuant to which services are to be rented, and/or material furnished in connection with any and all motion pictures or other productions to be based in whole or in part on the Literary Material.

In accordance with Section 622(b) of the Cable Act, the Licensee shall not be liable for a total financial commitment pursuant to this Renewal License and applicable law in excess of five percent (5%) of its Gross Annual Revenues and said five percent (5%) shall include: (i) the support for PEG Access pursuant to Section 6.3 and (ii) any License Fees payable to the Town and State pursuant to MGL chapter 166A.

Accordingly, I agree that I will not be entitled to any compensation because of the use by any WGAW Entity of any stories, ideas or materials that are similar or identical to the Literary Material, except as set forth in the next paragraph.

If any WGAW Entity uses, without my permission and in violation of my rights under U.S. Copyright Law, any portion(s) of the Literary Material that is/are expressed in sufficient detail that they are protected under U.S. Copyright Law, my remedy shall be limited to an award of money which shall not exceed the fair market value, as of the date of the unauthorized use, of the nonexclusive right to use similar material for a similar use.

I hereby waive any right to seek injunctive or other equitable relief in connection with any claim that I may bring that any WGAW Entity may have used any portion of the Literary Material in violation of my rights as set forth in this paragraph.

I understand that WGAW and persons or entities affiliated or connected with WGAW or the Project (each, a “WGAW Entity”) may have access to and/or may create or have created stories, ideas, and materials that may be similar or identical to the Literary Material in theme, idea, plot, format or other respects.

If the Literary Material is submitted by more than one person, then all such persons will sign this Release, the words “I”, “my”, “me” and the like throughout this Release shall refer to all such persons, and this Release will be binding jointly and severally upon all such persons.


More Definitions of Literary Material

Literary Material. Written matter, whether published or unpublished, in any form, including a novel, treatment, outline, screenplay, teleplay, story, manuscript, play or otherwise, which may be included in or upon which a Motion Picture may be based, but excluding characters, designs, visual representations, names, likenesses and/or characteristics of artists, physical properties or other materials appearing or used in or in connection with such Motion Picture.
Literary Material means written material other than Source Material, whether published or unpublished, in any form, including a theatrical motion picture treatment, outline, screenplay, teleplay, story, manuscript, play or otherwise, upon which a Motion Picture may be based (including any and all drafts thereof), which has been acquired by MVL either (i) with the proceeds of the Initial Funding (and on the same financial terms as the Literary Material Option) with respect to such Motion Picture or (ii) through the exercise of the Literary Material Option, and which, in each case, may be used solely in connection with the production of a Motion Picture.
Literary Material shall have the meaning set forth in the Master Agreement.

Related to Literary Material

Proprietary Materials means any tangible chemical, biological or physical research materials that are furnished by or on behalf of one Party to the other Party in connection with this Agreement, regardless of whether such materials are specifically designated as proprietary by the transferring Party.
Input Material means any Documents or other materials, and any data or other information provided by the Client relating to the Specified Service
Program Materials means the documents and information provided by the Program Administrator specifying the qualifying EEMs, technology requirements, costs and other Program requirements, which include, without limitation, program guidelines and requirements, application forms and approval letters.
Artwork means a Work which is an illustration, photograph, or other non-textual material which has been prepared for inclusion in an Educational Resource.
SAP Materials means any software, programs, tools, systems, data, or other materials made available by SAP or any other member of the SAP Group to Partner or to an End User (either directly or indirectly via Partner) prior to or in the course of the performance under any part of this Agreement including, but not limited to, the other SAP Products.
Documentary material means any book, paper, document, writing, drawing, graph, chart, photograph, phonograph record, magnetic tape, computer printout, other data compilation from which information can be obtained or from which information can be translated into usable form, or other tangible item.
IP Materials has the meaning given to it in clause E8.1 (Intellectual Property Rights).
Regulatory Materials means regulatory applications, submissions, dossiers, notifications, registrations, Regulatory Approvals and/or other filings made to or with, or other approvals granted by, a Regulatory Authority that are necessary or reasonably desirable in order to Develop, manufacture or Commercialize a Product in a particular country or regulatory jurisdiction. Regulatory Materials include INDs, MAAs and BLAs.
Developed Materials means Materials created, made, or developed by Contractor or Subcontractors, either solely or jointly with the Judicial Branch Entities or JBE Contractors, in the course of providing the Work under this Agreement, and all Intellectual Property Rights therein and thereto, including, without limitation, (i) all work-in-process, data or information, (ii) all modifications, enhancements and derivative works made to Contractor Materials, and (iii) all Deliverables; provided, however, that Developed Materials do not include Contractor Materials.
Earth material means any rock, natural soil or fill and/or any combination thereof.
Goods/Materials means any of the articles, materials, machinery, equipments, supplies, drawing, data and other property and all services including but not limited to design, delivery, installation, inspection, testing and commissioning specified or required to complete the order.
Asbestos-containing material or “ACM” means asbestos or any material containing more than one percent (1%) asbestos as determined using methods specified in 40 CFR 763, Subpart E, Appendix E, Section I, Polarized Light Microscopy* including Category I and Category II ACM and all friable material.
Licensed Material means the artistic or literary work, database, or other material to which the Licensor applied this Public License.
Promotional Material means a document or article distributed or provided wholly or partly for the purposes of promotion, advertisement, announcement or direction;
Licensed Know-How means all information (other than that contained in the Patents) whether patentable or not and physical objects related to the Product, including but not limited to Product data, Product-related results and information, including, but not limited to, clinical data, analytical test results, non-clinical pharmacology and safety data, other R&D data, Regulatory Documentation, manufacturing and formulation information of a like nature, all provided that the Licensed Know-How is known to, generated by, vested in (or licensed to) and/or controlled by IntelGenx, including, without limitation, the Licensed Know-How listed in Annex B of this Agreement.
Marketing Materials means all marketing brochures, buckslips, pamphlets, emails, text, call scripts or other material, whether in printed format, audio or audiovisual format, or in any other format, that contain any (i) Content relating to the Company Deliverables or (ii) Company Marks.
Promotional Materials means all sales representative training materials and all written, printed, graphic, electronic, audio or video matter, including, without limitation, journal advertisements, sales visual aids, formulary binders, reprints, direct mail, direct-to-consumer advertising, internet postings and sites and broadcast advertisements intended for use or used by either Party or its Affiliates or sublicensees in connection with any promotion of a Product.
Tax Materials means (i) the representation letters delivered to Tax Counsel in connection with the delivery of the Tax Opinion or the Supplemental Tax Opinion and (ii) any other materials delivered or deliverable by External Distributing, External SpinCo and others in connection with the rendering by Tax Counsel of the Tax Opinions or the Supplemental Tax Opinion.
Biological Material means any material containing genetic information and capable of reproducing itself or being reproduced in a biological system;
Product Information has the meaning set forth in Section 9.1.
Licensed Materials means any materials that Executive utilizes for the benefit of the Company (or any Subsidiary thereof), or delivers to the Company or the Company’s Customers, which (a) do not constitute Work Product, (b) are created by Executive or of which Executive is otherwise in lawful possession and (c) Executive may lawfully utilize for the benefit of, or distribute to, the Company or the Company’s Customers.
Construction materials means any tangible personal property that will be converted into real property.
Technical Information means technical data or computer software, as those terms are defined in the clause at DFARS 252.227-7013, Rights in Technical Data-Non Commercial Items, regardless of whether or not the clause is incorporated in this solicitation or contract. Examples of technical information include research and engineering data, engineering drawings, and associated lists, specifications, standards, process sheets, manuals, technical reports, technical orders, catalog-item identifications, data sets, studies and analyses and related information, and computer software executable code and source code.
Genetic material means any material of plant, animal, microbial or other origin containing functional units of heredity.
Biological Materials means certain tangible biological materials that are necessary for the effective exercise of the Patent Rights, which materials are described on Exhibit A, as well as tangible materials that are routinely produced through use of the original materials, including, for example, any progeny derived from a cell line, monoclonal antibodies produced by hybridoma cells, DNA or RNA replicated from isolated DNA or RNA, recombinant proteins produced through use of isolated DNA or RNA, and substances routinely purified from a source material included in the original materials (such as recombinant proteins isolated from a cell extract or supernatant by non-proprietary affinity purification methods). These Biological Materials shall be listed on Exhibit A, which will be periodically amended to include any additional Biological Materials that Medical School may furnish to Company.
Controlled technical information means technical information with military or space application that is subject to controls on the access, use, reproduction, modification, performance, display, release, disclosure, or dissemination. Controlled technical information would meet the criteria, if disseminated, for distribution statements B through F using the criteria set forth in DoD Instruction 5230.24, Distribution Statements on Technical Documents. The term does not include information that is lawfully publicly available without restrictions.
