Excluded Loss or Damage definition

Excluded Loss or Damage means any:
Excluded Loss or Damage means loss or damage of Xxxxxxxx Products occurring in the Warehouses or Warehouse and Freight Services Agreement Dated November 1, 2019 Between Xxxxxxxx Consumer Products LLC and Pactiv LLC otherwise while in the custody of Pactiv: (a) required to be covered by the insurance of Xxxxxxxx under Schedule 3 or actually covered by the insurance of Xxxxxxxx, or (b) in a calendar year of the Term, an amount of Xxxxxxxx Products that represents less than three-tenths of one percent (0.30%) of the total quantity of cases of Xxxxxxxx Products stored in the Warehouses in the calendar year.
Excluded Loss or Damage means loss or damage of Xxxxxxxx Products occurring in the Warehouses or Warehouse and Freight Services Agreement Dated November 1, 2019 Between Xxxxxxxx Consumer Products LLC and Pactiv LLC Confidential Treatment Requested by Evergreen Pactiv Group Inc. Pursuant to 17 C.F.R. Section 200.83 otherwise while in the custody of Pactiv: (a) required to be covered by the insurance of Xxxxxxxx under Schedule 3 or actually covered by the insurance of Xxxxxxxx, or (b) in a calendar year of the Term, an amount of Xxxxxxxx Products that represents less than three-tenths of one percent (0.30%) of the total quantity of cases of Xxxxxxxx Products stored in the Warehouses in the calendar year.

Related to Excluded Loss or Damage

  • Direct Damage has the meaning given to it in clause 26.2;

  • Property damage means physical injury to, de- struction of, or loss of use of tangible property.

  • Severe property damage means substantial physical damage to property, damage to the treatment facilities which would cause them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production.

  • Work loss means loss of income from work the injured victim would have performed if the injured victim had not been injured and expenses reasonably incurred by the injured victim in obtaining services in lieu of those the injured victim would have performed for income,

  • Consequential Loss means loss of profits, anticipated loss of profit or revenue, loss of production, loss of business opportunity, loss of or damage to goodwill or reputation, loss of use or any other similar loss, but excludes:

  • Substantial damage means damage of any origin sustained by a structure whereby the cost of restoring the structure to its before damaged condition would equal or exceed 50 percent of the market value of the structure before the damage occurred.
