Consumer Products definition

Consumer Products means machines designed for or adapted and used for horticulture, floriculture, landscaping, grounds maintenance, or turf maintenance, including but not limited to lawnmowers, rototillers, trimmers, blowers, and other equipment used in both residential and commercial lawn, gardening, or turf maintenance, installation, or other applications;
Consumer Products means devices that are not Professional Products. Consumer Products shall include, but are not limited to, consumer broadband access and small and home offices (SOHO) markets and the consumer broadcast (televisions, set-top boxes etc.)

Consumer Products means: (a) consumer lawn and garden products including, without limitation, plants, flowers, trees and shrubs, fertilizer, fertilizer combination products, seed, growing media (including, without limitation, peat products, soil conditioning agents, turf dressings, compost, mulches, combination growing media and bark), plant foods, wetting agents, plant protection products, pesticides, herbicides, insecticides, fungicides, rodenticides, repellents, bird food and durable applicators; and (b) any products sold or provided: (i) to professional or collegiate sporting fields and stadiums in the United States and Canada, solely for the purposes of supporting consumer marketing efforts; or (ii) to or by any lawn, tree, shrub and pest care service businesses catering mainly to consumers for non-commercial use and which use any trade marks owned by or licensed to the Seller or any member of the Retained Group. For the avoidance of doubt in relation to (a) above, Consumer Products will be further identified by reference to a combination of certain parameters such as package size, labelling, advertising, positioning and classification within store, price and targeted end user;
Consumer Products means devices, products, articles or merchandise of common or frequent use, ordinarily bought by individuals or households for private consumption from a retail outlet or otherwise obtained or provided direct to the consumer.
