COMPLIANCE WITH LAWS, STATUTES, REGULATIONS. During the term of this Master Contract, unless otherwise agreed, CONTRACTOR shall comply with all applicable federal, state, and local statutes, laws, ordinances, rules, policies and regulations. CONTRACTOR shall also comply with all applicable LEA policies and procedures unless, taking into consideration all of the surrounding facts and circumstances, a policy or policies or a portion of a policy does not reasonably apply to CONTRACTOR. CONTRACTOR hereby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with LEA policies and shall indemnify LEA under the provisions of Section 16 of this Agreement for all liability, loss, damage and expense (including reasonable attorneys’ fees) resulting from or arising out of CONTRACTOR’s failure to comply with applicable LEA policies (e.g., those policies relating to; the provision of special education and/or related services, facilities for individuals with exceptional needs, student enrollment and transfer, student inactive status, corporal punishment, student discipline, and positive behavior interventions). CONTRACTOR acknowledges and understands that XXX may report to the CDE any violations of the provisions of this Master Contract; and that this may result in the suspension and/or revocation of CDE nonpublic school/agency certification pursuant to California Education Code section 56366.4(a).

CONTRACTOR hereby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with LEA policies and shall indemnify LEA under the provisions of section 17 of this Master Contract for all liability, loss, damage and expense (including reasonable attorneys’ fees) resulting from or arising out of CONTRACTOR’s failure to comply with LEA policies. The CONTRACTOR shall comply with those policies, relating to among other things, the provision of special education and/or related services, facilities for individuals with exceptional needs, LEA pupil enrollment and transfer, LEA pupil inactive status, corporal punishment, pupil discipline, and positive behavior interventions.

COMPLIANCE WITH LAWS, STATUTES, REGULATIONS. No modifications can be made to this document by the CONTRACTOR.

COMPLIANCE WITH LAWS, STATUTES, REGULATIONS. During the term of this Contract, PROVIDER shall keep itself fully informed of the applicable state and federal laws and regulations relating to the performance of and compliance with this Contract, and shall at all times comply with such laws as they may be amended from time to time. PROVIDER hereby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with applicable federal and state laws and regulations, including DISTRICT policies which implement such laws and regulations, and shall indemnify DISTRICT for all liability, loss, damage and expense (including reasonable attorneys' fees) resulting from or arising out of PROVIDER’s failure to comply with such federal and state laws and regulations. This relates to, among other things: compliance with mandated reporting requirements; compliance with the Americans with Disabilities Act and any and all other applicable disability rights legislation; corporal punishment restrictions; mandated reporting requirements; positive behavior interventions; fingerprinting; and credentialing and licensing requirements for any and all services provided for in this Contract.

CONTRACTOR shall also comply with all DISTRICT policies unless CONTRACTOR and DISTRICT determines, taking into consideration all of the surrounding facts and circumstances, a policy or policies or a portion of a policy does not reasonably apply to CONTRACTOR. CONTRACTOR hereby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with DISTRICT policies and shall indemnify DISTRICT under the provisions on Indemnification and hold harmless section of this AGREEMENT for all liability, loss, damage and expense (including reasonable attorney’s fees) resulting from or arising out of CONTRACTOR’S failure to comply with DISTRICT policies.

CONTRACTOR hereby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with Shasta SELPA/District of Residence policies and shall indemnify Shasta SELPA/District of Residence under the provisions of Section 16 of this Agreement for all liability, loss, damage and expense (including reasonable attorneys’ fees) resulting from or arising out of CONTRACTOR’s failure to comply with applicable Shasta SELPA/District of Residence policies (e.g., those policies relating to, the provision of special education and/or related services, facilities for individuals with exceptional needs, student enrollment and transfer, student inactive status, corporal punishment, student discipline, and positive behavior interventions). CONTRACTOR acknowledges and understands that Shasta SELPA/District of Residence may report to the CDE any violations of the provisions of this Master Contract; and that this may result in the suspension and/or revocation of CDE nonpublic school/agency certification pursuant to California Education Code section 56366.4(a).

CONTRACTOR hereby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with SELPA policies/procedures and shall indemnify the Ventura County SELPA/VCOE under the provisions of section 16 of this Agreement for all liability, loss, damage and expense (including reasonable attorneys’ fees and costs) resulting from or arising out of CONTRACTOR’S failure to comply with SELPA/LEA policies/procedures. The CONTRACTOR shall comply with those policies/procedures, relating to among other things, the provision of special education and/or Related Services, facilities for individuals with exceptional needs, LEA student enrollment and transfer, SELPA/LEA student inactive status, corporal punishment, student discipline, and positive behavior interventions. CONTRACTOR herby acknowledges and agrees that it accepts all risks and responsibilities for its failure to comply with all applicable LEA policies/procedures and shall indemnify LEA under the provision of section 16 of this contract for such failure. CONTRACTOR acknowledges and understands that the SELPA/LEA may report to CDE any violations of the provisions of this Master Contract; and that this may result in the suspension and/or revocation of CDE nonpublic school/agency certification pursuant to California Education Code section 56366.4(a).
