COMMERCIALLY LAUNCH definition

COMMERCIALLY LAUNCH means the first introduction in the United States of Product by Par, or a Par Affiliate to each of a major retail chain and a major distributor (as those terms are commonly understood in the industry) after the FDA has approved the ANDA for the Product.
COMMERCIALLY LAUNCH shall have a corresponding meaning.
COMMERCIALLY LAUNCH means the first sale of the Product for the First Indication in commercial quantities in a given jurisdiction.

COMMERCIALLY LAUNCH means that Interplay has offered its FALLOUT MMOG for sale to the public in major markets in North America and Europe and that such FALLOUT MMOG has and continues to maintain a minimum of 10,000 paying subscribers.
COMMERCIALLY LAUNCH means (a) an initial release of the applicable Alternate Site Product to a limited number of the Company’s customers for a trial period to allow such customers to use such product and to confirm whether there are any operational issues that arise from the use of such product and (b) if such initial release does not reveal any significant operational issues and any other operational issues are remedied in a reasonable fashion, a full release of the applicable Alternate Site Product to the Company’s customers and distributors.

  • Commercially Useful Function means responsibility for the execution of a distinct element of the work of the contract, which is carried out by actually performing, managing, and supervising the work involved, evidencing the responsibilities and risks of a business owner such as negotiating the terms of (sub)contracts, taking on a financial risk commensurate with the contract or its subcontract, responsibility for acquiring the appropriate lines of credit and/or loans, or fulfilling responsibilities as a joint venture partner as described in the joint venture agreement.

  • Commercially Reasonable or “Commercially Reasonable Efforts” means, with respect to any action required to be made, attempted or taken by a Party under this Agreement, the level of effort in light of the facts known to such Party at the time a decision is made that: (a) can reasonably be expected to accomplish the desired action without a material increase in costs incurred by such Party; (b) is consistent with Prudent Industry Practices; and (c) takes into consideration the amount of advance notice required to take such action, the duration and type of action and the competitive environment in which such action occurs.

  • Medical marijuana product means a product that contains cannabinoids that have been extracted from plant material or the resin therefrom by physical or chemical means and is intended for administration to a licensed patient, including but not limited to concentrates, oils, tinctures, edibles, pills, topical forms, gels, creams, and other derivative forms, except that this term does not include live plant forms.

  • Launch Date has the meaning specified therefor in Section 2.02(b) of this Agreement.
