  • It is the intent of the Parties that no part of this Agreement be construed against any of the Parties hereto because of the identity of the drafter or the fact that the CNA Parties are insurance companies.

  • If the CNA Parties obtain the agreement of one or more other settling insurers to pay for joint publication of the notices respecting the Approval Motion in the USA Today, nothing herein is intended to prevent the CNA Parties from sharing the expense of such joint publication in lieu of each paying the cost of individual publications, and Congoleum agrees to cooperate with the CNA Parties in connection with such joint notices.

  • The CNA Parties are good faith purchasers of the Subject Policies for value within the meaning of section 363(m) of the Bankruptcy Code and are entitled to the protection thereof.
