Work of the Bargaining Unit / Agency Nurses. (a) Nurses who are in supervisory positions excluded from the bargaining unit shall not perform duties normally performed by nurses in the bargaining unit which shall directly cause or result in the layoff, loss of seniority or service or reduction in benefits to nurses in the bargaining unit. Nurses will be assigned duties and responsibilities in accordance with the Regulated Health Professions Act and other applicable statutes and regulations thereto. The Employer will not assign such duties and responsibilities to employees not covered by this Agreement unless those duties and responsibilities are appropriate to the position occupied by the person to whom the duties and responsibilities are being assigned and are consistent with quality patient care. Unless otherwise agreed by the Union and the Employer, work performed by full-time nurses will not be assigned to part-time nurses for the purpose of eliminating full-time positions. In order for the Union to be able to monitor the extent of work assignment between RNs and RPNs in the workplace, the Employer will provide the Union’s Labour Relations Officer and Bargaining Unit President with semi-annual reports (by March 31 and September 30 each year), by bargaining unit, site and by nursing unit, of the following:
