Without prejudice to Clause 16. 6, nothing in this Agreement will operate to exclude or restrict COLLABORATOR’s Liability:
Without prejudice to Clause 16. 1, this Agreement shall terminate as between a Party that transfers its Transferable Interests to the other Party or to a third party in accordance with this Agreement, and the other Parties (if any), on the relevant Transfer Date, provided that the party to which such Shares have been transferred has become (or was already) a party to this Agreement.
Without prejudice to Clause 16. 6, upon receipt of Notice under Clause 16.2 the Builder shall be entitled to arrange for inspection of the Vessel on its own behalf. The Owner shall make available to the representatives of the Builder at such inspection the Vessel's logbooks and any other relevant documents and information and shall supply such certified copies of such log books, documents and information as may reasonably be requested by the Builder.
Without prejudice to Clause 16. 6, nothing in this Agreement will operate to exclude or restrict Catapult’s Liability under the indemnity contained in Clause 15.
Without prejudice to Clause 16. 4.1 to 16.4.3 above, the Partners may agree to carry forward any underspend in relation to Pooled Funds or Non Pooled Funds provided that such carry forward will be in accordance with any relevant legal and accounting requirements.

Without prejudice to Clause 16. 1, if a Force Majeure event occurs prior to the Allocation Date, then such date and the Registration Date shall be delayed by a period equivalent to the duration of the Force Majeure event. 7
Without prejudice to Clause 16. 1, in the event of any conflict between the terms of this Agreement and any other document purporting to relate to the employment of the Executive (including the Employment Information CD or any applicable staff handbook), the terms of this Agreement prevail
Without prejudice to Clause 16. 2, BT will use all reasonable endeavours to minimise changes of individual personnel who are engaged or involved in providing the Services. Save as provided in Clause 16.2, BT reserves the right to determine which individual personnel will perform the Services and to replace whether temporarily Back to Contents or permanently such individual personnel during the period of the Agreement. At all times whilst performing the Services the BT Personnel, the members of the BT Group and the Subcontractors will remain under the sole control and direction of BT.
Without prejudice to Clause 16. 5, you will at all times after an Information Security Breach has occurred seek to mitigate the liabilities accruing from such Information Security Breach.
