Volume Fluctuations - Overtime and Guarantee. The "normal work week" shall be as set out in Section 10.2 below. Because, however, demand for the Company's products vary from season to season and from day to day, the Union agrees that it may at times be necessary to exceed or to reduce these basic hours of work. The Company will limit hours of work as far as reasonably possible. The Company will first discuss the matter with the Union, if gang overtime is involved, and when feasible, if overtime is involved for individuals. In consideration of the foregoing, the Company agrees to guarantee a minimum work week of 37 hours at regular rates of pay, subject to the provisions of Section 10.7.

Volume Fluctuations - Overtime and Guarantee. Except by agreement with the Union Business Representative, an employee’s regularly scheduled hours will be eight (8) hours daily and forty (40) hours weekly, on five (5) days per week. Because, however, demand for the Company’s work varies, the Union agrees that it may at times be necessary to exceed or to reduce these basic hours of work. In consideration of the foregoing, the Company agrees to limit overtime hours of work as far as reasonably possible and to guarantee a minimum work week of thirty-seven (37) hours at regular rates of pay, subject to the provisions of Section 10.6.

Under penalty of false swearing, a principal of the contracting firm shall certify that the proposal for rental rates and proposal for wage rates do not exceed current costs for like services. The Owner will in no event consider a rental rate in excess of eighty percent of the rate set forth in the latest edition of the "Compilation of Nationally Averaged Rental Rates for Construction Equipment" of the Associated Equipment Distributors unless the rates proposed in excess of eighty percent are supported by proof satisfactory to the Owner that the excess rates are reasonable. If the equipment is owned by the Contractor the costs shall be charged at a maximum of eighty percent of market monthly rental rates for the amount of time used. If applicable, transportation costs may be included. The decision of the Owner shall be final, binding and conclusive on all parties. Rental rates shall be payable only for the actual time the equipment is required on the Site.
