Use and Condition of Property. 5.1 Nothing set forth in this Lease shall be construed as a warranty by the Landlord that the Equipment shall continue in working order after the Commencement Date, nor shall anything set forth herein be construed as a warranty as to the condition of the Equipment or Supplies on the Commencement Date.

Use and Condition of Property. 11.1 The Tenant shall use the Property for residential purposes for occupation by the Tenant only and shall not (nor allow others to) operate a business at the property or use it for any improper, immoral or illegal purposes. If the Tenant wishes a guest to stay at the property for more than two consecutive nights or on a regular basis at weekends or during the week then this must be agreed in writing beforehand with the landlord.
Use and Condition of Property. All currently used property and assets of the Corporation are in good operating condition and repair as required for their use in the business of the Corporation as presently conducted or planned; and no notice of any violation of any law, statute, ordinance, or regulation or assessment for public improvements relating to any of such property or assets has been received by the Shareholders or the Corporation except such as have been fully complied with. All improvements located on, and the use presently being made of, all real property, leased or owned by the Corporation, comply with all applicable zoning ordinances. the Corporation and the Shareholders are not aware of any proposed, pending or threatened change in any such code, ordinance or standard which would adversely affect the business of the Corporation or the use of its property and assets. The Corporation has not received any written or oral notice or order by any governmental or other public authority, any insurance company which has issued a policy with respect to any of such properties or any board of fire underwriters or other body exercising similar functions which (a) relates to violations or alleged violations of building, safety, fire or other ordinances or regulations, (b) claims any defect or deficiency with respect to any such properties or (c) requests the performance of any repairs, alterations or other work to or in any of such properties or in the streets bounding the same. The Corporation and the Shareholders are not aware of any proposed, pending or threatened condemnation proceeding or similar action affecting the property or assets of the Corporation and there are no proposed, pending or threatened changes with respect to any streets or public amenities appurtenant thereto or in the vicinity thereof which would adversely affect the business of the Corporation or the use of its property and assets.
Use and Condition of Property. Seller shall take all action necessary to provide to Buyer the benefit of all manufacturer's warranties and maintenance contracts covering equipment included in the Purchased Assets, to the extent that such warranties exist and are in the possession of the Seller. Seller has taken no action nor has Seller failed to take any action that might nullify or release any such manufacturer from any liabilities under such warranties or maintenance contracts. EXCEPT AS PROVIDED HEREIN, NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, IS MADE WITH RESPECT TO THE CONDITION OR FITNESS FOR A PURPOSE OR PARTICULAR USE OF THE ASSETS INCLUDED IN THE PURCHASED ASSETS, IT BEING UNDERSTOOD THAT SUCH ASSETS ARE ACQUIRED OR PURCHASED BY BUYER IN AN "AS IS" CONDITION.

All improvements located on, and the use presently being made of all real property included in, the Purchased Assets or leased pursuant to the Assumed Liabilities comply with all applicable zoning and building code ordinances and all applicable fire, environmental, occupational safety and health standards and similar standards established by Law, and the same use thereof by Buyer will not result in any violation of any such code, ordinance or standard. To the knowledge of Sellers, there is no pending, proposed or threatened change in any such code, ordinance or standard which would adversely affect the Business or the use of the Purchased Assets.
Use and Condition of Property. The Purchased Assets include sufficient Assets in good operating condition and repair as are required for the operation of the Business as presently conducted, and conform, in all material respects, to all applicable Laws, and no notice of any violation of any Law relating to any of the Purchased Assets has been received by Seller or any other Seller Group Person except such as have been fully complied with. There is no pending or, to the knowledge of each Seller Group Person, threatened condemnation proceeding or similar action affecting the Purchased Assets or with respect to any streets or public amenities appurtenant thereto or in the vicinity thereof which would adversely affect the Business or the use of the Purchased Assets. 3.16
Use and Condition of Property. (a) To the Knowledge of each Seller owning the same, all of the Purchased Assets are in good operating condition and repair as required in all material respects for their use in the Business as presently conducted or planned and conform to all applicable Laws, and no notice of any violation of any Law relating to any of such property or assets has been received by Sellers except such as have been fully complied with. To the Knowledge of the applicable Seller, all improvements leased pursuant to the Assumed Liabilities comply with all applicable zoning and building code ordinances and all applicable fire, environmental, occupational safety and health standards and similar standards established by Law, and the same use thereof by Buyer will not result in any violation of any such code, ordinance or standard which would materially adversely affect the Business or the Purchased Assets. To the Knowledge of any Sellers Group Person, there is no pending, proposed, or threatened change in any such code, ordinance or standard which would materially adversely affect the Business or the use of the Purchased Assets.

There is no proposed, pending or threatened condemnation proceeding or similar action affecting the Purchased Assets or with respect to any streets or public amenities appurtenant thereto or in the vicinity thereof which would adversely affect the Inspector Business or the use of the Purchased Assets.
Use and Condition of Property. Except as expressly set forth on Schedule 2.17, all of the Assets are in good operating condition and repair as required for their use in the Business as presently conducted. All the Assets have been used, maintained, and serviced by Seller in accordance with commercially reasonable business practices, and no notice of any violation of any law, statute, ordinance, or regulation relating to any of the Assets has been received by Seller or Shareholder. To the knowledge of Seller and Shareholder, all improvements located on and the use presently being made by Seller of the Leased Real Property comply with all applicable zoning and building code ordinances and all applicable fire, environmental, occupational safety, and health standards and similar laws or regulations. There is no proposed, pending, or, to the knowledge of Seller and Shareholder, threatened change in any such code, ordinance, or standard which would, or could reasonably be expected to, adversely affect the Business or the use of the Assets. Seller is in compliance with the Americans with Disabilities Act ("ADA") and Seller has not received notice from any individual, entity or federal, state, or local governmental agency or official notifying Seller that Seller or any property or asset of Seller is in violation of, or in noncompliance with, the ADA.
