Upon Termination for Convenience the Contractor shall recover as its sole remedy payment for (1) Work properly performed in connection with the terminated portion of the Work prior to the effective date of termination, and (2) items properly and timely fabricated off the Project site, delivered and stored in accordance with the Owner’s instructions, The Contractor hereby waives and forfeits all other claims for payment and damages, including without limitation, anticipated profits. In calculating the amount due Contractor under this Section 20.4, the Owner shall be credited for (1) payments previously made to the Contractor for the terminated portion of the Work, and (2) claims which the Owner has against the Contractor under the Contract.
