Third-Party Claims Administrator. 8.1 The costs and expenses related to claims administration shall be paid from the Settlement Fund. Because the costs and expenses of claims administration will affect each Class Member’s share of the Settlement Fund, the costs and expenses of claims administration shall be overseen by Class Counsel. Xxxxx’s counsel may also oversee the claims administration process as they deem necessary. The Parties will use good faith efforts to minimize the costs of claims administration.
Third-Party Claims Administrator. The Claims Administrator shall be responsible for all matters relating to the administration of this settlement, as set forth herein. Those responsibilities include, but are not limited to, giving notice, setting up and maintaining the Settlement Website and toll-free telephone number, fielding inquiries about the settlement, processing claims, acting as a liaison between Class Members and the Parties regarding claims information, and any other tasks reasonably required to effectuate the foregoing. The Claims Administrator will provide monthly updates on the claims status to counsel for all Parties.

Third-Party Claims Administrator. (1) To assist TIG in the administration of Program Business as set forth in Section 6.1 above, the parties agree that Sedgwick James of Mississipxx, Xxx. xxxxx be appointed as the third party claims administrator of the Program Business (the "Administrator") on such terms and conditions as TIG and the Administrator shall agree upon, subject to the approval of the Trust. Sedgwick James of Mississipxx, Xxx. xxxxx continue as the Program Administrator so long as it is in compliance with (i) all applicable laws and regulations of the states in which the Program Administrator conducts operations on behalf of TIG with regard to the Program Business; and (ii) the terms of the agreement to be entered into between TIG and the Program Administrator.
Third-Party Claims Administrator. The parties agree that Sedgwick James of Mississipxx, Xxx. ("Xxxgwick") shall be appointed as third party claims administrator to handle Claims arising out of the Covered Obligations. The Trust shall have Sedgwick perform such administration at no cost to Continental pursuant to that certain Continuation of Service Agreement dated as of May 9, 1996 (the "Service Agreement") between the Trust and Sedgwick which rights to administration at no cost shall be assigned to Continental. The Trust agrees to transfer to Continental all files related to the Covered Obligations and to cooperate with Continental with respect to servicing of the Claims.

Those responsibilities include, but are not limited to, obtaining addresses for the Class whose addresses are not provided by SmartPay (including by reverse telephone look up), providing notice, obtaining new addresses for returned mail, setting up and maintaining the Settlement Website and toll-free telephone number, fielding inquiries about the settlement, processing claims, acting as a liaison between Class Members and the Parties regarding claims information, directing the mailing of settlement payments to Class Members, maintaining reasonably detailed records of exclusion requests and objections, and any other tasks reasonably required to effectuate the administration of this Agreement. The Claims Administrator will provide, at a minimum, monthly updates on the claims status to counsel for all Parties and will respond to the Parties’ questions about the status of the case or related matters in a timely manner.

Those responsibilities include, but are not limited to, giving notice, obtaining new addresses for returned mail, setting up and maintaining the Settlement website and toll-free telephone number, publishing one nationwide publication in USA Today, fielding inquiries about the Settlement, processing claims, acting as a liaison between Class Members and the Parties regarding claims information, approving claims, rejecting any claim where there is evidence of fraud, directing the mailing of settlement payments to Settlement Class Members, and any other tasks reasonably required to effectuate the foregoing. The Claims Administrator will provide weekly updates on the claims status to counsel for both Parties.
Third-Party Claims Administrator. 7.1 The Parties will use good faith efforts to minimize the costs of claims administration. Class Counsel will make the final determination of which claims administrator to select for Court approval.

Those responsibilities include, but are not limited to, giving notice, obtaining addresses (as practicable) for Class Members based on cellular phone numbers contained in Defendants’ records, obtaining new addresses for returned mail, setting up and maintaining the Settlement Website and toll-free telephone number, fielding inquiries about the Settlement, processing claims, acting as a liaison between Class Members and the Parties regarding claims information, approving claims, rejecting any Claim Form where there is evidence of fraud, directing the mailing of settlement payments to Settlement Class Members, and any other tasks reasonably required to effectuate the foregoing. The Claims Administrator will provide weekly updates on the claims status to counsel for all Parties.
