Agents and Representatives. The duties of Contractor to indemnify and hold Commissioners free and harmless per the terms of this Road Impact Agreement, or the Street Standards, shall apply to Commissioners, Elkhart County Government Generally, and to the officers, agents, elected officials, employees, and representatives thereof.
Agents and Representatives. The Secured Party may perform any of its duties and exercise any of its rights and powers through one or more agents appointed by it. The Secured Party and any such agent may perform any of its duties and exercise any of its rights and powers through its Representatives. The exculpatory provisions of Section 15 and this Section shall apply to any such agent and to the Representatives of the Secured Party and any such agent.

Agents and Representatives. It is understood and agreed that (a) the Administrative Agent is entering into this Agreement in its capacity as administrative agent and collateral agent under the Credit Agreement and the provisions of Article 9 of the Credit Agreement applicable to the Agents (as defined therein) thereunder shall also apply to the Administrative Agent hereunder (b) the Senior Representative for the Additional Senior Debt Parties under the 2018 Notes Indenture is entering into this Agreement solely in its capacity as collateral agent under the 2018 Notes Indenture and the provisions of the 2018 Notes Indenture applicable to the Collateral Agent (as defined therein) thereunder shall also apply to the Senior Representative for the Additional Senior Debt Parties under the 2018 Notes Indenture hereunder and (c) [ ] is entering into this Agreement solely in its capacity as [Collateral Agent] under the Initial Second Priority Debt Documents and the provisions of such agreements applicable to the Collateral Agent thereunder shall also apply to the Initial Second Priority Representative hereunder.
Agents and Representatives.
