Stand Alone Network Upgrades. The proposed Camp Xxxxxxxxx Case Springs 230 kV Gas Insulated Switchyard (GIS) is the Southern Interconnection for the project. In the IFAS, the proposed Camp Xxxxxxxxx Case Springs 500/230 kV substation was modeled 14 miles from the SDG&E Talega 230 kV substation and 37 miles from the SDG&E Escondido 230 kV substation. The existing Talega – Escondido 230 kV line will loop into the SDG&E Camp Xxxxxxxxx Case Springs Switchyard. The 230 kV Camp Xxxxxxxxx Case Springs Switchyard will be constructed with GIS technology at an additional cost estimated by SDG&E to be $21.159 million over the cost for similar Air Insulated Switchyard (AIS) facilities for the Reliability Network Upgrades set forth in Table A.1 below. The incremental cost for GIS is treated as a non-refundable advance in aid of construction that is grossed up for applicable federal taxes at 37% or approximately $7.8 million. Nevada Hydro shall be responsible for the cost differential between (i) the cost of installed AIS facilities as determined by the lowest acceptable bid received and (ii) the actual cost of installed GIS facilities, and such difference would not be treated as contemplated by Section 5.17 of the LGIA. Land requirements for the installation of the Switchyard facilities will include:  A land right in recordable form that grants perpetual and assignable rights for the Switchyard of a size and configuration and otherwise meeting SDG&E’s specifications and requirements, all subject to approval by SDG&E in its reasonable discretion, and provided that the land rights may be in a form that limits use of the land to the Switchyard.  The Switchyard pad shall be graded to SDG&E’s specifications in its sole discretion, consistent with SDG&E standard practices or good engineering practices, whichever is higher.  A wall or fence that encloses the Switchyard land and provides for adequate access and working room, to SDG&E's specifications in its sole discretion, consistent with SDG&E standard practices or good engineering practices, whichever is higher.   • Network Upgrades The Transmission Owner shall design, procure, construct, install, and own the Network Upgrades described in Attachment 6 of this Agreement. If the Transmission Owner and the Interconnection Customer agree, the Interconnection Customer may construct Network Upgrades that are located on land owned by the Interconnection Customer. Unless the Transmission Owner elects to pay for Network Upgrades, the actual cost of the Network Upgrades, including overheads, shall be borne initially by the Interconnection Customer.

  • NON-NETWORK PROVIDER is a provider that has not entered into a contract with us or any other Blue Cross and Blue Shield plan. For pediatric dental care services, non-network provider is a dentist that has not entered into a contract with us or does not participate in the Dental Coast to Coast Network. For pediatric vision hardware services, a non-network provider is a provider that has not entered into a contract with EyeMed, our vision care service manager.

  • Software Upgrades Software Upgrades consist of new product releases which are issued periodically and may include new functionality, enhancements, and bug fixes. Software Upgrades are provided only for standard hardware platforms and operating systems supported by COMSPOC as described in the Documentation. Software Upgrades will apply only to unmodified Software and commercially released updated versions of the Software. You are responsible for making or arranging for updates to interfaces for nonstandard devices or custom applications. Software Upgrades are provided subject to the terms and conditions of the then current and applicable COMSPOC Software License Agreement, available on COMSPOC’s website at xxxx://xxx.xxxxxxx.xxx/sla or with the deliverable Software or upon request. All major product releases and maintenance releases will be made available and may be shipped directly to you, upon request by contacting your COMSPOC point of contact or xxxxxxx@xxxxxxx.xxx. You may upgrade to the latest product version at any time during the term of the Annual Support and Upgrades Agreement. If you opt not to renew the Annual Support and Upgrade Agreement, You have 60 days from the end of the Annual Support and Upgrades Agreement term to upgrade to the latest product version available prior to the end of the Annual Support and Upgrades Agreement term. If You request an upgrade beyond this 60-day period, You will be required to renew the Annual Support and Upgrades Agreement in order to upgrade to the latest product version.

  • Network Access TENANT may find it necessary to purchase a network interface card, wireless PC card or other hardware in order to connect to the internet service. LANDLORD is not responsible for the purchase of these items and LANDLORD cannot guarantee compatibility with any device TENANT may have. The computer and network card must have software installed that supports the Internet Protocol commonly referred to as TCP/IP. Any conflicts between the software compatibility of the network and the TENANT’S computer operating system or any other feature will be the responsibility of the TENANT to resolve. LANDLORD will not be responsible for software issues related to the user’s personal computer.

  • Web Hosting If Customer submits a Service Order(s) for web hosting services, the following terms shall also apply:

  • Access to Network Interface Device (NID 2.4.3.1. Due to the wide variety of NIDs utilized by BellSouth (based on subscriber size and environmental considerations), Mpower may access the on-premises wiring by any of the following means: BellSouth shall allow Mpower to connect its loops directly to BellSouth’s multi-line residential NID enclosures that have additional space and are not used by BellSouth or any other telecommunications carriers to provide service to the premise. Mpower agrees to install compatible protectors and test jacks and to maintain the protection system and equipment and to indemnify BellSouth pursuant to Section 8 of the General Terms and Conditions of this Agreement.

  • System Upgrades The Connecting Transmission Owner shall procure, construct, install, and own the System Upgrade Facilities and System Deliverability Upgrades described in Attachment 6 of this Agreement. To the extent that design work is necessary in addition to that already accomplished in the Class Year Interconnection Facilities Study for the Interconnection Customer, the Connecting Transmission Owner shall perform or cause to be performed such work. If all the Parties agree, the Interconnection Customer may construct System Upgrade Facilities and System Deliverability Upgrades.

For the purposes of this section, the Contractor warrants and represents that it is authorized and empowered to and hereby grants the State and the third-party provider of MFMP the right and license to use, reproduce, transmit, distribute, and publicly display within the system the information outlined above. In addition, the Contractor warrants and represents that it is authorized and empowered to and hereby grants the State and the third-party provider the right and license to reproduce and display within the system the Contractor’s trademarks, system marks, logos, trade dress, or other branding designation that identifies the products made available by the Contractor under the Contract.
