Network Upgrades has the meaning set forth in the CAISO Tariff.

Network Upgrades means any upgrades to the Pool Transmission Facilities and the Transmission Provider’s transmission and distribution systems, including any System Modifications under the Interconnection Agreement, necessary for Delivery of the Energy to the Delivery Point, including those that are necessary for the Facility’s Capacity to be recognized as a Capacity Resource pursuant to the ISO-NE Rules.

• The Parties intend that all payments or property transfers made by Interconnection Customer to Transmission Provider for the installation of Transmission Provider's Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be non-taxable, consistent with status of Transmission Provider as a municipal entity under applicable tax law and regulations.

• Accounts and records related to the design, engineering, procurement, and construction of Transmission Provider's Interconnection Facilities and Network Upgrades shall be subject to audit for a period of twenty-four months following Transmission Provider's issuance of a final invoice in accordance with Article 12.2.

• Transmission Provider must conduct the necessary studies and construct the Network Upgrades needed to integrate the Generating Facility in a manner comparable to that in which Transmission Provider integrates its generating facilities to serve native load customers.

• To the extent Interconnection Customer wants to receive Network Resource Interconnection Service, Transmission Provider shall construct and Interconnection Customer shall pay for the facilities identified in Appendix A (Interconnection Facilities, Network Upgrades and Distribution Upgrades) to this GIA, subject to Article 11.5 of this GIA.

• Each Party may in accordance with Good Utility Practice in coordination with the other Party remove from service any of its respective Interconnection Facilities, Network Upgrades, or Distribution Upgrades that may impact the other Party's facilities as necessary to perform maintenance or testing or to install or replace equipment.

More Definitions of Network Upgrades

Network Upgrades means those facilities located beyond the point of interconnection of the generating facility to the transmission grid.

Network Upgrades means the additions, modifications and upgrades required at or beyond the Electric Interconnection Point to accommodate Full Deliverability.

Network Upgrades means all additions, improvements and upgrades to the network facilities, as defined by the Transmission System Code, for the connection of the Facility, as more particularly specified pursuant to the System Impact Assessment, Customer Impact Assessment and Transmission System Code for generator or storage connections.

Network Upgrades has the meaning set forth in the CAISO Tariff. “Non-Defaulting Party” has the meaning set forth in Section 11.2.

Network Upgrades means all apparatus, modifications, and additions to the Transmission Owner’s electric system, the New York Transmission System or, if applicable, an affected system, that is required at or beyond the Interconnection Point that are required for the Project to connect reliably to the New York Transmission System.
