Rotation of Overtime. Section 1. Whenever the Employer/Fire Chief determines that overtime is necessary, such opportunities shall be offered first to shift employees in accordance to the overtime rotation list. Should all shift employees refuse or be unavailable to work the overtime, the Employer may offer the work/shift to non-shift bargaining unit employees provided they have the proper training. In the event that any of the above said employees are unavailable to work the assignment, the least senior bargaining unit employee shall be required to work the assignment. If an employee should refuse overtime of twelve (12) hours or more, said employee shall be charged twelve (12) hours for refusing. Twelve (12) hours or less, shall be charged accordingly. Employees shall then be placed accordingly in overtime rotation. This will not be in effect for personnel on Vacation or Xxxxx leave. An updated list of accumulated over time for all employees shall be posted electronically via the Employer Bulletin Board as a Read-Only file following each pay period. This list shall be used for call in purposes when overtime becomes available. The employee with the least accumulated overtime will be called first and continuing up the list to the employee with the most accumulated overtime until said overtime has been filled.

Said employee shall be forced to work the first 12 hours of the overtime shift, with the option to work the shift in its entirety. If the forced employee only works the first 12 hours of the shift, the next least senior member of the shift prior to the necessary overtime shift shall be forced to work the second 12 hours of the overtime shift. In the event that the members of the same shift are required to work overtime, employees that have previously been forced to work overtime shall be exempt from forced overtime until every member of the shift has worked a forced overtime shift. Rotation of Overtime. (a) Overtime work shall be rotated through a cycle on the basis of work unit seniority among employees with the same job title in a work area; provided, however, that employees may be offered the opportunity to opt-out of the overtime rotation once per quarter, within the first full week of March, June, September, and December of each calendar year. An employee’s decision to opt-out remains in effect until changed by the employee during the identified opt-out selection time periods. Employees who opt out of the overtime rotation forgo the opportunity to volunteer for overtime but may be required by the University to work overtime as provided for in Section 117.7. Whenever An employee who refuses overtime work that is estimated by management to last one hour or more shall lose that turn in the Employer/Fire Chief determines that overtime cycle. Overtime that is to last four (4) hours or more and that is scheduled three (3) work days in advance will, if no qualified employee in the work area desires such work, be offered to qualified employees in that job title in the work unit who have volunteered for such work. Such overtime until said work shall be rotated in the same way overtime has been filledwork is rotated within the work area. The rate paid shall be time and one-half the employee’s regular rate, provided that if the work is in a grade lower than the employee’s present grade, and the overtime is voluntary, the employee shall be paid the rate of the lower grade job at the appropriate point in the salary scale attained by the employee and provided further if the work is in a grade higher than the employee’s present grade, the employee shall be paid a rate based on the provisions of Section 18.2, Article XVIII —Temporary Transfer. If through an oversight an employee misses a turn of overtime, that employee shall be provided an opportunity to work sufficient overtime hours to compensate for the overtime hours missed, at a time mutually agreeable to the employee and the employee’s supervisor, and the employee shall be paid at the rate of twice the hourly rate for such hours worked.
