Return to Work after Parental Leave. (a) A staff member shall be entitled to the position which the staff member held immediately before proceeding on parental leave or, in the case of a staff member who was transferred to a safe job pursuant to subclause (3) of this clause, to the position which the staff member held immediately before such transfer. Where such position no longer exists but there are other positions available for which the staff member is qualified and the duties of which the staff member is capable of performing, the staff member shall be entitled to a position as nearly comparable in status and salary or wage to that of the staff member’s former position.
