Removal of Structures. Tenant shall advise Landlord within ten (10) --------------------- days prior to the exercise of the Option whether or not Tenant intends to utilize the structures located on the Property. In the event Tenant intends not to utilize such structures, Landlord shall have the right to remove such structures from the Property at its sole cost and expense.

Removal of Structures. Nothing in this Agreement shall prevent LICENSOR from removing Structures from service from time to time for reasons such as maintenance, reconfiguration of LICENSOR’s transmission and distribution routes, or conversion of overhead infrastructure to underground. In the event LICENSOR desires to remove a Structure from service, LICENSEE will remove its Fiber within thirty (30) calendar days of receipt of notice to do so (or such shorter period reasonable under the circumstances in the case of emergency or such longer period reasonable under the circumstances approved by LICENSOR, which approval shall not be unreasonably withheld, conditioned or delayed). Any Fiber remaining after thirty (30) calendar days (or other period if applicable) may be removed by LICENSOR, and LICENSEE shall be responsible for payment of LICENSOR’s costs in removing said Fiber, upon receipt of an invoice from LICENSOR. No refund of any current year rental will be due LICENSEE upon the removal of Structures from service.

Removal of Structures. The party initiating the right to use and occupy the lands and leases of the other party may, at its sole risk, cost and expense, remove or relocate any structures located upon the lands and leases to be used and occupied, provided that said removal or relocation is approved in writing by the party whose structures are to be removed or relocated; and further provided that, notwithstanding anything contained in this Agreement to the contrary, such relocations shall be in accordance with any agreements pertaining thereto between the parties hereto entered into prior to this Agreement. Removal of Structures. LESSEE shall have the right to remove any improvements and any personal property placed on the land by LESSEE, provided that the same shall be removed within ninety (365) days after the expiration of the term of this permit, provided that the LESSEE shall properly restore any damage caused thereby to the subject tract or any improvements remaining thereon; provided further, that DIVISION shall also have the right to retain without compensation to LESSEE, but with costs of removal and disposal chargeable to LESSEE, those improvements and items of personal property left upon the permitted premises beyond ninety (365) days after the expiration of this permit.

If the tenant wishes to leave a structure on their plot upon termination, the Council will consult the likely future tenant to establish whether they are willing to accept responsibility for it. In the event that there is no likely future tenant, the Council will inspect the structure and determine whether to allow it to be left on the plot.
