Relationship to the Awards. The parties intend that this Agreement shall form the complete agreement covering all terms and conditions of employment. It shall operate to the exclusion of any and all awards and supersedes any previous arrangements or agreements. For the avoidance of doubt this excludes all protected award conditions.

Relationship to the Awards. The parties intend that this Agreement shall form the complete agreement covering all terms and conditions of employment. It shall operate to the exclusion of any and all awards and supersedes any previous arrangements or agreements. For the purposes of s354 and Schedule 8 of the Workplace Relations Act, this Agreement excludes the operation of the following protected award or notional agreement provisions: • Rest breaks; • Incentive-based payments and bonuses; • Annual leave loadings; • Public holidays entitlements and payments, including substitute days; • Monetary allowances relating to expenses, responsibilities or disabilities; • Penalty rates or loadings for working overtime or shift work; and • Any other protected award provisions prescribed by the Regulations to the Act.
Relationship to the Awards. This Agreement shall be read and interpreted wholly in conjunction with: The Local Government (State) Award 2001; The Local Government Engineers Senior Staff Award 1999; and Any amendments to those Awards. The provisions of the Agreement will override the provisions of the award where they conflict, otherwise where the Agreement is silent the Award shall prevail.
Relationship to the Awards. This agreement shall operate in conjunction with the relevant Award (the Social & Community Services (State) Award and the Miscellaneous Workers Kindergartens Child Care Centres (State) Award as appropriate) but the Agreement will prevail to the extent of any inconsistency between the relevant Award and this Agreement. All applicable Awards terms and conditions will be maintained for the life of this Agreement.
Relationship to the Awards. ‌ Council has negotiated with its employees an enterprise agreement that, when taken as a whole, is in excess of Award conditions at the time of signing. Movements in the Award will not follow onto those covered by the Agreement until such time that employees suffer an overall disadvantage. Any movements in Award conditions will not be viewed in isolation.

  • Relationship to Parent Award This Agreement incorporates all the terms and conditions of the Award (AW825280CAV) as at 10 April 2006 with the exception of clauses 13, 16.2.1, 22.3.4, 22.3.5, 37.6 and 40.3. Where there is inconsistency between the Award and this Agreement, the latter will prevail but only to the extent of the inconsistency.

  • Relationship to Other Agreements You agree that when you use Mobile Banking, you will remain subject to the terms and conditions of all your existing agreements with us or any service providers of yours; including service carrier or provider and that this Agreement does not amend or supersede any of those agreements. You understand that those agreements may provide for fees, limitations and restrictions which might impact your use of Mobile Banking (for example, your mobile service carrier or provider may impose data usage or text message charges for your use of or interaction with Mobile Banking, including while downloading the Software, receiving or sending Mobile Banking text messages, or other use of your Wireless device when using the Software or other products and services provided by Mobile Banking), and you agree to be solely responsible for all such fees, limitations and restrictions. You agree that only your mobile service carrier or provider is responsible for its products and services. Accordingly, you agree to resolve any problems with your carrier or provider directly with your carrier or provider without involving us. You also agree that if you have any problems with Mobile Banking, you will contact us directly.

  • Resolving an Employment Relationship Problem The employee and employer should first make a reasonable effort to discuss the problem and settle it by mutual agreement. (If it’s a personal grievance, it must first be raised with the employer within 90 days - Personal Grievances are explained further below). An employee (or employer) has the right to be represented at any stage. When a problem arises, union members should contact their local NZEI Te Riu Roa field officer for advice and representation. Employers should contact NZSTA or other adviser/representative of choice.
