Relationship to Parent Award and Previous Agreement. This Agreement shall be read and be interpreted, wholly in conjunction with the Metal, Engineering and Associated Industries (State) Award, as amended from time to time - provided that where there is any inconsistency between this Agreement and the Metal, Engineering and Associated Industries (State) Award - this Agreement shall take precedence to the extent of the inconsistency.

Relationship to Parent Award and Previous Agreement. This Agreement shall incorporate the Funeral Industry Award 2003 set immediately prior to reaching agreement (the “Award”) excluding clauses 9.1.3 and 16.5.2 of the Award (attached Part B of this agreement). Where there is any inconsistency between the Award and this Agreement, the terms of this Agreement shall prevail. Provided that if subsequent variations to the above Award clauses during the life of this Agreement are more beneficial to employees than the provisions of this Agreement, those superior variations (or superior parts of) shall be incorporated into this Agreement and shall prevail over the Agreement to the extent of any inconsistency. Existing over-award payments and conditions of employment shall also continue to apply as if they were an express term of this agreement, except where the terms of this agreement expressly provide otherwise. Any new facilitative arrangement referred to in the Award and introduced as a result of the award simplification case, shall not be used during the life of this Agreement, unless with the written agreement of the Union.

  • Relationship to Parent Award This Agreement incorporates all the terms and conditions of the Award (AW825280CAV) as at 10 April 2006 with the exception of clauses 13, 16.2.1, 22.3.4, 22.3.5, 37.6 and 40.3. Where there is inconsistency between the Award and this Agreement, the latter will prevail but only to the extent of the inconsistency.
