Refund of Security. Amounts provided by Seller as Contract Security will be refunded to Seller by NYSERDA as follows:

Amounts required by Seller as Contract Security will be reduced and refunded by NYSERDA to Seller as follows: Within thirty (30) Business Days of XXXXXXX’s receipt of an Independent Engineer’s report (which may be the same report submitted for purposes of Section 2.01(c) of this Agreement) demonstrating that the Operational Installed Capacity equals or exceeds the product of 0.95 and the Offer Capacity. On a prorated basis, expressed as a fraction of the Contract Security equal to the Operational Installed Capacity divided by the product of 0.95 and the Offer Capacity, within thirty (30) Business Days of NYSERDA’s receipt of an attestation from the appropriate representative of Seller that the Operational Installed Capacity is greater than zero and less than the product of 0.95 and the Offer Capacity. For clarity, the cumulative total amount of Contract Security returned to Seller under this Section 15.06(b) at any point in time shall not exceed the amount equal to the Contract Security multiplied by the Operational Installed Capacity at that point in time divided by the product of 0.95 and the Offer Capacity.

Refund of Security. 1.10.1 On expiry of the period of license the contractor may, if he does not intend to have his license renewed, make an application to the licensing officer for the refund of the security deposited by him under Rule 24. If the licensing officer is satisfied that there is breach of the conditions of license or there is no order under section 14 for the forfeiture of security or any portion thereof, he shall direct the refund of the security to the applicant.

Amounts required by Grant Recipient as Contract Security will be refunded by NYSERDA to Grant Recipient within thirty (30) Business Days of Commencement of Construction and satisfaction of the other requirements set forth in Section IV.E.2.a; provided that (i) Contract Security shall not be refunded an Event of Default is ongoing or if a Termination Event occurs and (ii) NYSERDA shall have the right in its sole discretion to retain the Contract Security until Substantial Completion in the event that construction is delayed or suspended prior to the refund of Contract Security.

Amounts required by Seller as Contract Security will be reduced and refunded by NYSERDA to Seller as follows: Within thirty (30) Business Days of NYSERDA’s receipt of an invoice submitted pursuant to Article IV of this Agreement establishing that Seller has met the Minimum Delivery Requirement for either a Winter Capability Period or a Summer Capability Period. Within thirty (30) Business Days of a termination pursuant to Section 14.01(g). Amounts provided by Seller as Contract Security and not refunded pursuant to this Section 15.06 above will be retained by NYSERDA.
Refund of Security. Simultaneously with the receipt of the payment to be made to it pursuant to paragraph "3" hereof, COSI shall take such steps as may be required to permit a portion of the security deposited (or otherwise posted by) Subtenant under the sublease, equal to Seventy and 79/100 Per Cent (70.79%) of the amount thereof, to be released to Subtenant (or the Letter of Credit reduced accordingly).
Refund of Security. To refund to the Tenant on the termination of this Agreement the Deposit held by the Landlord under the provisions of this Agreement provided there is no existing breach of any of the Tenants covenants herein contained or of any of the rules and regulations made from time to time by the Management Corporation or the relevant statutory authorities.
