Publication 5.3 Zveřejnění/Publikace. 5.3. 1 The parties acknowledge that Sponsor shall retain ownership of all original Case Report Forms that result from this Study. However, the Investigator shall have publication or presentation privileges provided such manuscript and/or abstract is submitted to Sponsor via e-mail to for review and comment sixty (60) days prior to submission for publication or sixty (60) days prior to presentation. Sponsor shall return comments to Institution within thirty (30) days after receipt of the draft Institution Publication (“Review Period”), and Institution agrees and shall require Institution Personnel to agree that due consideration shall be given to Sponsor comments. Institution shall delay any proposed Institution Publication an additional ninety (90) days in addition to the Review Period in the event Sponsor so requests to enable Sponsor and/or its affiliates, and/or collaborators to secure patent or other proprietary protection (“Delay Period”).If in or Sponsor’s judgment, publication or presentation at a given time would hinder Sponsor’s development of the Investigational Product, the Investigator shall consider modifying the publication or presentation schedules accordingly.   • PUBLICATION AND PUBLICITY The CONSULTANT agrees that it shall not for any reason whatsoever communicate to any third party in any manner whatsoever concerning any of its CONTRACT work product, its conduct under the CONTRACT, the results or data gathered or processed under this CONTRACT, which includes, but is not limited to, reports, computer information and access, drawings, studies, notes, maps and other data prepared by and for the CONSULTANT under the terms of this CONTRACT, without prior written approval from the COMMISSION, unless such release or disclosure is required by judicial proceeding. The CONSULTANT agrees that it shall immediately refer any third party who requests such information to the COMMISSION and shall also report to the COMMISSION any such third party inquiry.
