Public Holidays Prescribed Holidays. A full-time employee under this Agreement is entitled to the following public holidays, without loss of pay: • New Year DayAustralia DayGood FridayEaster SaturdayEaster MondayAnzac Day • Queen's Birthday • Labour Day • Christmas Day • Boxing Day • Where another day is generally observed in a locality in substitute for any of the above days, that day will be observed as the public holiday in lieu of the prescribed day. (i) Where Christmas Day falls on a Saturday or a Sunday, 27 December will be observed as the public holiday in lieu of the prescribed day. (ii) Where Boxing Day falls on a Saturday or a Sunday, 28 December will be observed as the public holiday in lieu of the prescribed day. (iii) Where New Year's Day or Australia Day falls on a Saturday or a Sunday, the following Monday will be observed as the public holiday in lieu of the prescribed day. Substitution of Public Holidays by Agreement between the parties (i) By Agreement between the Employer and the majority of an alternative day may be taken as the public holiday in lieu of any of the prescribed days. (ii) The Employer and individual employee may agree to the employee taking another day as the public holiday in lieu of the day, which is being observed as the public holiday in the enterprise or relevant section of the enterprise.

An employee other than a casual employee will be paid an additional 150% on 1/38th of the appropriate ordinary weekly rate fixed in clause 3.5 for all hours worked on a day proclaimed or declared a public holiday. When an employee is absent from his or her employment on his or her normal working day before or after a public holiday without reasonable excuse or without the consent of Spotless, that employee will not be paid for such holiday. Should any of the public holidays fall on a day on which an employee, other than a casual employee, is rostered to work and that employee is not required to work, that employee will receive payment for that day at ordinary time rates. Public Holidays Prescribed Holidays. 41.1 An Employee, other than a casual Employee is entitled to payment at the (1) New Year’s Day; (2) Australia Day; (3) Labour Day; (4) Good Friday; (5) Easter Monday; (6) Anzac Day; (7) the Queens birthday holiday; (8) Christmas Day; (9) Boxing Day or Proclamation Day; and (10) or such other day proclaimed by the relevant State/Territory legislation or Proclamation in addition to or in substitution for any of the above days in which case the substituted day will be deemed to be the holiday for the purposes of this Agreement.
