Provisions Applicable When the Legislature Does Not Appropriate Funds for Bail Hearings. These provisions apply for FY 2023 (from July 1, 2022, through June 30, 2022). In addition, they shall apply in the event that the Legislature fails to appropriate funds in the future for the purpose of compensating prosecutors and defense attorneys who are required to appear, or to be available to appear, in court on a weekend or holiday for bail hearings. In the event that the Legislature fails to make this appropriation, the County shall notify the ECPAA in writing not less than sixty (60) days before reverting to compensation for bail hearings under this subsection. Employees who are scheduled to appear in court on non-holiday weekends shall receive “Weekend Availability Pay” in the amount of one-and-a-half (1.5) times their normal hourly rate, as set forth in Exhibit C, in addition to their full regular base salary. Employees shall receive a minimum of one hour of Weekend Availability Pay when scheduled for weekend court. Employees who work more than one hour on a non-holiday weekend shall report their actual hours worked, rounded up to the nearest one-quarter (1/4) of an hour and receive Weekend Availability Pay for said hours. Employees who are scheduled to appear in court on a holiday or on a holiday weekend shall receive “Holiday Availability Pay” in the amount of two-and-a-half (2.5) times their normal hourly rate, as set forth in Exhibit C, in addition to their full regular base salary. Employees shall receive a minimum of one hour of Holiday Availability Pay when scheduled for holiday or holiday weekend court. Employees who work more than one hour on a holiday or holiday weekend shall report their actual hours worked, rounded up to the nearest one-quarter (1/4) of an hour and receive Holiday Availability Pay for said hours. Employees performing other work on a weekend or holiday, which is unrelated to a scheduled court appearance on a weekend or holiday, shall not be eligible for Weekend Availability Pay or Holiday Availability Pay. All weekend, holiday, and holiday weekend court appearances shall be assigned at the discretion of the District Attorney and Public Defender with as much notice as possible.

  • General Provisions In connection with any Registration Statement and any Prospectus required by this Agreement to permit the sale or resale of Transfer Restricted Securities (including, without limitation, any Registration Statement and the related Prospectus required to permit resales of Initial Securities by Broker-Dealers), each of the Company and the Guarantors shall:

  • Data Protection All personal data contained in the agreement shall be processed in accordance with Regulation (EC) No 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the EU institutions and bodies and on the free movement of such data. Such data shall be processed solely in connection with the implementation and follow-up of the agreement by the sending institution, the National Agency and the European Commission, without prejudice to the possibility of passing the data to the bodies responsible for inspection and audit in accordance with EU legislation (Court of Auditors or European Antifraud Office (XXXX)). The participant may, on written request, gain access to his personal data and correct any information that is inaccurate or incomplete. He/she should address any questions regarding the processing of his/her personal data to the sending institution and/or the National Agency. The participant may lodge a complaint against the processing of his personal data with the [national supervising body for data protection] with regard to the use of these data by the sending institution, the National Agency, or to the European Data Protection Supervisor with regard to the use of the data by the European Commission.

  • Grievance Procedure 7.01 For purposes of this Agreement, a grievance is defined as a difference arising between the parties relating to the interpretation, application, administration or alleged violation of the Agreement including any question as to whether a matter is arbitrable.

  • Dimensions Education Bachelor’s or Master’s Degree in Computer Science, Information Systems, or other related field. Or equivalent work experience. Experience: A minimum of 7 years of experience with large and complex database management systems.

  • Scope of Services The specific scope of work for each job shall be determined in advance and in writing between TIPS Member, Member’s design professionals and Vendor. It is permitted for the TIPS Member to provide a general scope description, but the awarded vendor should provide a written scope of work, and if applicable, according to the TIPS Member’s design Professional as part of the proposal. Once the scope of the job is agreed to, the TIPS Member will issue a PO and/or an Agreement or Contract with the Job Order Contract Proposal referenced or as an attachment along with bond and any other special provisions agreed by the TIPS Member. If special terms and conditions other than those covered within this solicitation and awarded Agreements are required, they will be attached to the PO and/or an Agreement or Contract and shall take precedence over those in this base TIPS Vendor Agreement.

  • Definitions and Interpretation 1.1 In this Agreement:

  • Personal Leave Written request for a personal leave of absence without pay will be considered on an individual basis by the Hospital. Such requests are to be submitted to the employee's immediate supervisor at least four (4) weeks in advance, unless not reasonably possible to give such notice, and a written reply will be given within fourteen (14) days except in cases of emergency in which case a reply will be given as soon as possible. Employees needing personal leave days for appointments with medical practitioners may utilize the personal leave language. Such leave shall not be unreasonably withheld.

  • In General A. To provide all services in the Contract Type and in the Service Area, specified in Section I of this Contract.

  • Procedure If any action is brought against an Underwriter, a Selected Dealer or a Controlling Person in respect of which indemnity may be sought against the Company pursuant to Section 6.1, such Underwriter, such Selected Dealer or Controlling Person, as the case may be, shall promptly notify the Company in writing of the institution of such action and the Company shall assume the defense of such action, including the employment and fees of counsel (subject to the reasonable approval of such Underwriter or such Selected Dealer, as the case may be) and payment of actual expenses. Such Underwriter, such Selected Dealer or Controlling Person shall have the right to employ its or their own counsel in any such case, but the fees and expenses of such counsel shall be at the expense of such Underwriter, such Selected Dealer or Controlling Person unless (i) the employment of such counsel at the expense of the Company shall have been authorized in writing by the Company in connection with the defense of such action, or (ii) the Company shall not have employed counsel to have charge of the defense of such action, or (iii) such indemnified party or parties shall have reasonably concluded that there may be defenses available to it or them which are different from or additional to those available to the Company (in which case the Company shall not have the right to direct the defense of such action on behalf of the indemnified party or parties), in any of which events the reasonable fees and expenses of not more than one additional firm of attorneys selected by such Underwriter (in addition to local counsel), Selected Dealer and/or Controlling Person shall be borne by the Company. Notwithstanding anything to the contrary contained herein, if any Underwriter, Selected Dealer or Controlling Person shall assume the defense of such action as provided above, the Company shall have the right to approve the terms of any settlement of such action which approval shall not be unreasonably withheld.
