Common use of Proportionate Leave on Termination Clause in Contracts

Proportionate Leave on Termination. 26.9.1 If an employee: • after one month’s continuous service in the first qualifying twelve monthly period with an employer, leaves the employment of the employer or his/her employment is terminated by the employer, or • after twelve months’ continuous service with an employer, leaves the employment of the employer or his/her employment is terminated by the employer; the employee shall be paid a twelfth of his/her ordinary rate of wage at the same rate in respect of each completed month of continuous service, the service being service in respect of which leave has not been granted hereunder.

Proportionate Leave on Termination. 26.9.1 If an employee: • 18.9.1 An employee other than a casual who after one monthweek’s continuous service in the first qualifying twelve 12 monthly period with an employerthe company, lawfully leaves the employment of the company or is terminated by the company through no fault of the employee, or, after 12 months continuous service with the company, leaves the employment of the employer or his/her employment is terminated by the employer, or • after twelve months’ continuous service with an employer, leaves the employment of the employer or his/her employment is terminated by the employer; the employee company for any reason shall be paid a twelfth of his/her 2.923 hours for each 38 ordinary rate of wage at the same rate in respect of each completed month of continuous service, the service being service hours worked and in respect of which leave has had not been granted hereunderunder this clause at the appropriate wage rate calculated in the paragraph “Payment of Period for Annual Leave”.
