Post-Accident Testing Requirements. An employee covered by this MOA who is involved in an accident (as defined in part 390.5 or 655.44 of the Federal Regulations) while performing their assigned duties shall be required to submit to drug and/or alcohol testing as mandated by FMCSA or FTA rules. The employee shall remain readily available for testing unless there is a life-threatening or life- saving occurrence requiring the employee to vacate the scene.
