Obligations In The Event of Suspension or Revocation. In the event that USFWS and/or CDFW suspend or revoke the Permits pursuant to Sections 19.0 and 21.0 of the IA, PSE will remain obligated to fulfill its mitigation, enforcement, management, and monitoring obligations, and its other HCP/NCCP obligations, in accordance with this Agreement and applicable statutory and regulatory requirements for all impacts resulting from implementation of the Project prior to the suspension or revocation.

Obligations In The Event of Suspension or Revocation. In the event that USFWS and/or CDFG suspend or revoke the Permits pursuant to Sections 19.0 and 21.0 of this Agreement, the Permittees will remain obligated to fulfill their mitigation, enforcement, management, and monitoring obligations, and their other HCP/NCCP obligations, in accordance with this Agreement and applicable statutory and regulatory requirements for all Covered Activities authorized for Take prior to the suspension or revocation.
Obligations In The Event of Suspension or Revocation. In the event of revocation or termination of a Permit, or of suspension of a Permit pursuant to Sections 16.2 or 16.3, above, consistent with the requirements of 50 Code of Federal Regulations sections 17.32(b)(7) and 17.22(b)(7), the Permittees remain liable for all incidental take of Covered Species that occurred prior to revocation and shall fully implement all measures required under the Yolo HCP/NCCP to minimize and mitigate for such take until the applicable Wildlife Agency determines that all Take of Covered Species that occurred under the Permit has been mitigated to the maximum extent practicable in accordance with the Yolo HCP/NCCP. Regardless of whether the Permit is terminated, suspended, or revoked, the Permittees acknowledge that lands added to the reserve system must be protected, managed and monitored in perpetuity.

Obligations In The Event of Suspension or Revocation. In the event of revocation, termination, or suspension of the State Permit, Permittee will remain obligated to fulfill any existing and outstanding minimization and mitigation measures and conservation measures required under this Agreement, the Plan, and the NCCP Permit, including measures to ensure rough proportionality under the NCCPA and Section 16.2.2., for any Take that occurs prior to such revocation, termination, or suspension, until CDFW determines that all Take of Covered Species that occurred under the NCCP Permit has been mitigated in accordance with this Agreement, the Plan, and the NCCP Permit.

  • Permit Suspension or Revocation The Service may suspend or revoke the permit for cause in accordance with the laws and regulations in force at the time of such suspension or revocation (50 CFR 13.28(a)). The Service may also, as a last resort, revoke the permit if continuation of permitted activities would likely result in jeopardy to covered species (50 CFR 17.22/32(d)(7)). The Service will revoke because of jeopardy concerns only after first implementing all practicable measures to remedy the situation.

  • Additional Event of Suspension Section 4.01. Pursuant to Section 6.02 (l) of the General Conditions, the following additional event is specified, namely, that a situation has arisen which shall make it improbable that the Program, or a significant part thereof, will be carried out.

  • Suspension upon Concessionaire Default Upon occurrence of a Concessionaire Default, the Authority shall be entitled, without prejudice to its other rights and remedies under this Agreement including its rights of Termination hereunder, to (i) suspend all rights of the Concessionaire under this Agreement including the Concessionaire's right to collect charge(s), and other revenues pursuant hereto, and (ii) exercise such rights itself and perform the obligations hereunder or authorise any other person to exercise or perform the same on its behalf during such suspension (the "Suspension"). Suspension hereunder shall be effective forthwith upon issue of notice by the Authority to the Concessionaire and may extend up to a period not exceeding 180 (one hundred and eighty) days from the date of issue of such notice; provided that upon written request from the Concessionaire and the Lenders’ Representative, the Authority shall extend the aforesaid period of 180 (one hundred and eighty) days by a further period not exceeding 90 (ninety) days.
