The Marina shall let the mooring or berth on hire specified in Item 5 of Schedule A (“the Berth”) to the Boat Owner and the Boat Owner shall hire the Berth from the Marina on the Terms and Conditions of this Agreement herein contained, provided always that the Boat Owner’s use of the Berth shall not be exclusive.

Where payments are agreed: The Parties agree that prior to receiving payment the Participating Site shall submit an invoice in accordance with Schedule A setting out the costs incurred and payment claimed. Payment by Imperial shall be without prejudice to any claims or rights which Imperial may have against the Participating Site and shall not constitute any admission by Imperial as to the performance by the Participating Site of its obligations under the Site Agreement and this Agreement.

This Agreement shall commence on 07/09/2022 and unless terminated in accordance with the School’s terms and conditions of contract (“Terms and Conditions”), which are appended to this Agreement, shall continue for a term of 3 years (“Agreement Period”). The School may upon written agreement with the Provider extend the Agreement Period for a further period not exceeding 1 year. Any extended term agreed shall form part of the Agreement Period.
