Notification to Eligible Claimants. At the time of payment by check, Eligible Claimants will be notified that the check represents their payment under this Agreement. The notification will inform the recipient about the dispute process described in Paragraph 4.09 below.

The determination of the Individual Relief type and amount is final and not subject to challenge by the claimant. The Settlement Administrator shall provide each Class Member with a notice advising him or her to seek personal tax advice regarding any tax consequences of the Settlement disbursement. The notice regarding the potential tax treatment to Class Members shall be included with each disbursement to Class Members. For the avoidance of doubt, neither the Defendant, nor Defendant’s Counsel, nor Class Counsel, have made, or are making in connection with the Settlement, any representations regarding possible tax consequences relating to the Settlement disbursements to Class Members, and neither Defendant, Defendant’s Counsel nor Class Counsel shall be held responsible for any such tax consequences.
