NETWORK LATENCY GUARANTEE. For Dedicated Internet Access Customer only, MHO guarantees the monthly average Network Latency for round-trip packets carried between Customer demarcation point and MHO’s IP Gateway to be an average of < 45ms or less. This average latency is measured as the average of 15 Minute samples as taken throughout a calendar month. After being notified by the Customer of Network Latency in excess of the rates specified above, MHO will use reasonable best efforts to determine the source of such Network Latency and to correct such problems within 2 hours. If MHO fails to remedy such Network Latency within two (2) hours of being notified of any excess Network Latency and average Network Latency for the proceeding 30 days has exceeded the rates specified above, the Customer will receive, at the Customer’s request, a Service Credit as follows:  One (1) day Service Credit for each additional hour after first two (2) hours of degraded performance  One (1) month Service Credit for each 24 hours of degraded performance Customer may obtain no more than one (1) month Service Credit for any given month.

NETWORK LATENCY GUARANTEE. For Dedicated Internet Access customers only, the monthly average Network Latency for packets carried over the COGENT Network between Backbone Hubs for the following regions is as specified below: Intra-North America: 45 milliseconds or less Intra-Europe: 35 milliseconds or less New York to London (Transatlantic): 85 milliseconds or less Los Angeles to Tokyo (Transpacific): 140 milliseconds or less Network Latency (or Round trip time) is defined as the average time taken for an IP packet to make a round trip between Backbone Hubs within the regions specified above on the COGENT Network. COGENT monitors aggregate latency within the COGENT Network by monitoring round-trip times between a sample of Backbone Hubs on an ongoing basis. After being notified by Customer of Network Latency in excess of the rates specified above, COGENT will use commercially reasonable efforts to determine the source of such excess Network Latency and to correct such problem to the extent that the source of the problem is on the COGENT Network. If COGENT fails to remedy such Network Latency within two (2) hours of being notified of any excess Network Latency and average Network Latency for the preceding 30 days has exceeded the rates specified above, Customer will receive, at Customer’s request, a Service Credit for the period from the time of notification by the Customer until the average Network Latency for the preceding 30 days is less than the rates specified above. Customer may obtain no more than one (1) month Service Credit for any given month.

If EPIK fails to remedy such Network Latency within two (2) hours of being notified of any excess Network Latency, and average Network Latency for the preceding 30 days has exceeded the rate specified above, Client will receive, at Client’s request, a Service Credit for the period from the time of notification by the Client until the average Network Latency for the preceding 30 days is less than the rates specified above. Client may obtain no more than one (1) month Service Credit for any given month.
NETWORK LATENCY GUARANTEE. The Switch Network carries packets with an average Network Latency over a one-month period of less than 75 milliseconds. Switch monitors aggregate latency within the Switch Network by monitoring round trip times between a sample of backbone hubs on an ongoing basis. “

NETWORK LATENCY GUARANTEE. The XO MPLS Network (as defined in the previous section) is guaranteed to have an average round-trip packet transit time within the XO MPLS Network over a calendar month within the time frames stated in Table 1 below. The average latency is measured as the average of five-minute samples across the XO MPLS Network taken throughout the month. The XO MPLS Latency guarantee does not include the local access circuit (local loop), CPE or Customer's LAN, scheduled maintenance events, Customer caused outages or disruptions, and force majeure events (defined in the relevant service contract). If the Latency guarantee is not met in a calendar month, Customer will receive a credit of 1/30th of the MRC for that month for each full 1ms above the average maximum guaranteed under this SLA. Limits on the credit and the reporting procedures are detailed below. Packet Delivery Objective The XO MPLS Network (as defined in the first section) is targeted to deliver either Frame Relay or Ethernet frames within the XO MPLS Network at the percentages set forth in Table 1 below, averaged over a calendar month.
