Common use of Military Duty Leave Clause in Contracts

Military Duty Leave. Any employee required or volunteering to serve in the Armed Forces of the United States shall be granted leave without pay for such service. An employee returning from such leave shall be returned to employment, without prejudice, provided application for reemployment is filed within six (6) months following the date of discharge or release from active military duty, and provided further that the Board shall have up to six (6) months to reassign the employee to duty in the school system.
