Management/Confidential Employees, City Hall and Yard Bargaining Units. Upon the receipt of a timely request, the Human Resources Director shall set the matter for hearing before the appropriate hearing body, as expeditiously as is possible and shall give the grievant and any other person requesting the same, written notice of the time and place of the hearing. Upon mutual agreement, the parties may utilize an individual from the State Mediation and Conciliation Services for the appeal of grievances. The parties would further agree that any determination or recommendation made by such individual shall be final and binding. If the parties cannot agree to the use of State Mediation and Conciliation Services, and chose to utilize the services of an "Arbitrator", both parties agree to pay half of the costs involved for such arbitration.
