Common use of Leave, President, O Clause in Contracts

Leave, President, O. N.A. Upon application in writing by the Association on behalf of the nurse to the Home, a leave of absence shall be granted to such nurse elected to the office of President of the Ontario Nurses' Association for a period of up to three (3) consecutive two (2) year terms. Notwithstanding Article 10.04, there shall be no loss of service or seniority during such leave of absence. During such leave of absence, the nurse's salary and applicable benefits shall be maintained by the Home and the Association agrees to reimburse the Home in the amount of the full cost of such salary and applicable benefits. It is understood, however, that during such leave the nurse shall be deemed to be an employee of the Ontario Nurses' Association. The nurse agrees to notify the Home of her intention to return to work at least two (2) weeks prior to the date of such return. The parties agree that if the return of the nurse results in the lay-off of a nurse in the bargaining unit the notice of lay off provisions in the collective agreement shall be waived.

Notwithstanding Article 10.0413.5 (a), there shall be no loss of service or seniority for a nurse during such leave of absence. During such leave of absence, the nurse's salary and applicable benefits shall be maintained by the Home Employer and the Association Union agrees to reimburse the Home Employer in the amount of the full cost of such salary and applicable benefits. It is understood, however, that during such leave the nurse shall be deemed to be an employee of the Ontario Nurses' Association. The nurse agrees to notify the Home Employer of her or his intention to return to work at least two twenty-eight (228) weeks calendar days prior to the date of such return. The parties agree that if the return Leave of the nurse results in the lay-off of a nurse in the bargaining unit the notice of lay off provisions in the collective agreement absence under this provision shall be waivedin addition to Association leave provided in Article 13.5 (a) of this Agreement. Notwithstanding the above, the Employer and the Union may make alternate arrangements in respect to salary and benefit continuation.
